Coastal Prelitigation Reports & Reviews (1)

- Monroe, LA, USA

I received a phone call from (855)-619-8310 with an automated recording telling me that I was being investigated. I dialed any number on my keypad as per the instructions of the automated recording and was connected to an operator. I was told that I was being investigated for defrauding a bank and writing bad checks in the amount of $570.00. I told her I did not know what she was referring to. She told me that I had taken out a payday loan through Mack Development which services three payday loan companies: Cash Central, Check Into Cash, and Cash Net USA, all of which are licensed in Louisiana to do internet payday loans per the agent. She told me my previous physical address and email address and previous phone number. She told me that Mack Development was ready to pursue legal action against me. I asked her for the number of Mack Development and she said that it would only be a general phone number and she could not guarantee that I would speak to the correct servicer. She told me that she could transfer me to the senior case analyst.

She transferred me to a Robert Gardner who stated that he was the senior case analyst. He told me that Mack Development was filing suit against me for an attempt to defraud a financial institution on January 26, 2011. When I asked him what the original loan date was, he said that was information he did not have and that Mack Development did not furnish him with that information. He then verified my previous physical address, previous email address, the last four digits of the account number that the money was allegedly wired to and the name of the bank. He stated that Mack Development has an in-house collections group that had sent correspondence multiple times to my address and tried to contact me via the email address. When I told him that the email address is one that I had not used in several years and that the address is one that I have not lived at in several years, he stated that's probably why I had not received anything. He told me that the company, Mack Development, only has to prove that they wired the money into my account. I asked him why was this collection attempt not on my credit report. He told me that because payday loan companies lend such small amounts they do not have to check credit to approve the loan. He told me that he would put a 24 hour hold on the account while I researched and figured out if I wanted to settle out of court and just pay the money or if I wanted to dispute the matter and then they would serve me papers for court. He said it sounded as if I was a victim of identity theft and I would need proof of such an incident such as police reports, notification to credit bureaus, etc. With that, we ended the call.

I called back an hour or so later and a Tasha Smith or Scott, I believe, answered the phone. I tried to get identifying information of the company from her. She only asked why, who I was, if I was being investigated by them. Of course, I didn't give her much information about me. She then hung up on me. I called back a couple of hours later and asked to speak with Robert Gardner. The operator asked me if I had an extension. I gave her the extension and she transferred me.

I told Robert that I needed more information. I asked him to send me a copy of what he has in front of him. I also asked him to explain to me what exactly Mack Development is and how they tie into the three payday loan companies. He explained a process of how they go about wiring the money into the account. He told me that once the individual fills out the online application which ever payday loan company gets the application they first call the bank to make sure the social security number is linked to the account and then they call the employer to verify how much that individual makes; once the loan is approved they wire it to the account. I asked him what happens in the case that the individual is self-employed (which they claimed I said I was). He said then they would call the number the individual gave as the work number and verify income amounts with that individual.

I asked him for Coastal's address and he told me that for security reasons he could not give it out. I then asked for the website address and he told me he could not give that out as they do not solicit business. I told him because I was told by the individual who answered the phone that Coastal services all 50 states, that I assumed they had an internet presence. He became agitated and told me that giving out their information would be a conflict of interest because he and Coastal are trying to help me. I told him I didn't understand how they were trying to help me when they represent Mack Development; I then said now that is a conflict of interest. I asked him for Mack Development's contact information. He told me that he couldn't give it, but that I could Google the company's name and Google would give me the contact number. I kept pressing for identifying information and proof of this alleged loan and he got really agitated and gave me nothing. He then said he would go ahead and escalate this case and that the initial hold was being removed from account then hung up on me.
