This is Mike Thomas from the legal department of Logo Venture.
We have received an application to register the trademark for the same business name as yours ,,,,
As part of the process, we have to conduct a federal search to make sure that the mark is not already trademarked or if it is being used by any other applicant. Upon conducting the initial search for the mark in question, we discovered that you might be using the same name the other applicant is willing to trademark.
The trademark is provided on a first come first serve basis and is registered federally, through the United States Patent and Trademark Office. This means, whoever registers the trademark first, will have ownership of the business name in all 50 states.
Since you already are an existing client of Logo Venture, we are giving you the priority to choose, if you're willing to reserve the trademark rights and registration under your ownership or should we proceed with other applicant.
If the owner of the trademark finds someone else using the same business name anywhere in all 50 states, they'll be legally allowed to send them a cease and desist letter.
Therefore, if you get the trademark done, no one else will be able to use the same name anywhere in all 50 states. However, if we proceed with their application and if they get the federal ownership and protection for the mark/name then you'll be required to cease all use of this name as per the Trademark Law.
As per the Act of 1946 §§ 1051 et seq, it is mandatory to register your mark to hold the ownership rights federally.
We would appreciate it if you could revert to this email in the next 12-24 hours. In case of no contact from you in the next 12-24 hours, the other applicant will be given the opportunity to begin their registration following the standard examination and filing procedure with USPTO.
