The company is misrepresenting itself as a legitimate commercial real estate mortgage private lender. They offered an LOI to a client but required a $145,000 upfront closing fee equivalent to 1 point on the total gross loan amount. This is a tactic commonly used by "fee shops." Industry standard is to have the closing fee paid out of a third-party escrow account at closing; however, they demanded that it all be paid upfront directly into their company account. Their LOI does state that the fee is refundable, but this is a ruse.
