I was offered a job, and signed a contract for the position, which had a start date of Jan 4, 2024 (although I didn’t actually start until Jan 28). The terms were the first month would be probationary, and a check would be mailed to me at that time, as well as a determination of whether I would be given permanent position. About two weeks into the job, I was offered permanent status, which I accepted. On day 30, I received an email stating the check was mailed on the afternoon of Feb 28, but would take about 10 days to arrive by mail (?), and that I could opt-in to direct deposit, as stated in the contract.

I had been in communication with 4 Uprows employees during this time—Dakota Montero, HR Mngr; Jamie Huff, my supervisor/Curator; Nicole Evans, and Lisa Gilbert, both from Payroll. In addition, I used their software (HEAVE CRM, Enterprise Application Software, version 23.3.2, Uprows Inc.) to conduct my work, and to communicate with my supervisor by its Chat feature.

The day after they stated the check was mailed, when I tried to login, there was a message stating, “System under maintenance (#32000). The database is currently offline and will be accessible on [date]”, where [date] is about one to three days in the future; this has continued to be the case (today [date]=03/17/2024).

I have what I believe is a legally binding contract stating all of the above regarding pay and status. However, the main company phone has been disconnected, and the numbers I have for the individuals I interacted with all go to voicemail. I’ve left repeated requests, by phone, text, email, and LinkedIn for them to contact me. Note that the two people I’ve tried to contact (Ms. Montero and Ms. Huff) both have a presence on LinkedIn that shows they are Uprows employees in the fields they had indicated.

Note also that, other than a little money I spent on supplies, I haven’t given them any money directly, but only by working for them. I did supply personal information in the contract and in an IRS W-9 form I completed when hired. However, as I had given up my previous job to take the Uprows position, I am at a loss of much more than the one-month salary (plus two weeks additional in pursuing this matter). Anything you can do to either straighten this out or prevent others from having to undergo this seeming predation will be greatly appreciated.

I was initially contacted through my e-mail. I have a LinkedIn account and this company does as well. First email was from [email protected] on Mon, Jan 8, as follow:

"Hello!

I hope this message finds you well. Your profile has caught our attention for the Fulfillment Manager-Supply Chain Management role with our company.

Salary: $4,700 per month

Full-time

Remote position

I email them back a little sceptical but I figure, let's just see what this is about. Next email I got it on Tue, Jan 16 from [email protected] at this point I had already forgot about the previous email but this one has the "uprows.com" so you can say it is a company, which I google and look on LinkedIn, not just the company but the name of the person. The email is as follows:

"Dear Job Seeker!

We are very pleased to let you know that Uprows has an opening for the position of Supply Associate. Please find a link at the bottom of this email to learn more about this opportunity. If you are interested, we'd love you to apply.

Uprows takes great pride in providing unmatched benefits and promoting a healthy work-life balance. This is a work from home incumbent, and you will be working remotely, M-F, 9AM to 5PM your local time. If hired, you will start with a 30-day probationary period at Uprows, and your performance during this initial 30-day will decide if you're suitable for a permanent, full-time position.

Your salary during the 30-day probationary period will be 4500 CAD. Once you become a full-time contractor, you will receive 5000 CAD. There will also be a set allocated amount separate from your salary for reimbursable expenses. We are looking for independent individuals who can work with minimal supervision and possess outstanding time management skills and have a keen set of eyes for details.

So at this point, I'm less suspicious. There was nothing online about scams from this site, so I applied. Got an email from [email protected] as follow: "Thank you for your interest. Your application for the position of Supply Associate has been received. Ensure to whitelist [email protected] to get your interview appointment if your application is approved. We will let you know the outcome within 24 hours."

I got scheduled for an interview from Dakota Montero as she is HR, the email has attached 2 PDF files with Supply Associate position summary and position details . Got interviewed in the next couple of days and got an email later from Dakota Montero as follow:

"Dear (My name),

We are very happy to be able to extend you a conditional offer for the position of Supply Associate at Uprows Inc. We are glad that you have chosen Uprows as your new career destination and we cannot wait to have you onboard.

Per our discussion, your starting salary will be 4500 CAD for the 30-day probationary period and will be paid out at the end of the 30-day period via bank transfer. You're also allocated an additional 130 CAD for certain out-of-pocket expenses that will be reimbursed by Uprows.

This is a remote, work from home incumbent with the expectation that you'll work from 9AM to 5PM your local time, Monday through Friday.

You will receive a RightSignature® email with the Independent Contractor Agreement soon. This conditional job offer is contingent upon successful submission of the Independent Contractor Agreement and required documents. Once Uprows verifies and approves your submission, all conditions will be removed, and this offer will be final.

Read the Independent Contractor Agreement in its entirety, ask any questions before signing. Follow the instruction included to sign the RightSignature® Independent Contractor Agreement. Seek clarification prior to signing the document, signing the document indicates you have read and understood all the terms outlined in the Independent Contractor Agreement and that you agree to abide by those terms without any reservation.

Once your Independent Contractor Agreement and required documents have been submitted and approved, you will be assigned a supervisor within 1-2 business days. Then I got the Employment Agreement to sign and put me in contact with the person who is going to be my supervisor and name Jamie Huff - [email protected] direct line (323) 818-4682, as well as setting up my account to the CRM (heave-crm.com) system that it will be use for the orders. I also get to contact the Payroll department at [email protected], named Lisa Gilbert so she can set up my e-transfer for payments. Payroll also sends me an email as follow:

"Welcome to our team. It's a pleasure to meet you!

First things first. As you have read in your Employment Agreement, your first day of work will begin once you process your first order. This day will be reflected in the CRM system as: My Account - Account Details - Account Open Date. The dates of your following paydays will be shown there as well.

For your probation month you will earn 4500 CAD base rate + 130 CAD transport expenses = 4630 CAD/month.

In a full time position you will earn 5000 CAD base rate + 200 CAD transport expenses = 5200 CAD/month.

We've got few perks to offer you once you get on board with us:

Sometimes you will incur other job-related expenses for items such as clear packing tape, ink cartridges, basic printer, etc. You are eligible for reimbursement on these products. Just email the copies of your receipts for job related purchases to Payroll Department as an attachment. You can send them one by one, or submit all of them at the end of your probation.

The reimbursement for job related expenses, as well as a fixed amount of gas reimbursement will be added to your first paycheck altogether. No need to attach receipts for gas.

Please, keep in mind that you are eligible to receive a bonus for any extra working hours. Keep notes on every weekend/overtime processing (including order ID's) in any format, which is more convenient for you, and then email it to me 3 days prior the end of your probation.

As soon as the received information is confirmed by our Sales Department, the total amount of bonuses will be calculated and added to your first paycheck.

Now let's get to the specific documentation we need to receive from you in order to make sure your paycheck gets processed smoothly and in time on your scheduled payday.

Your first payment for probationary period will be processed on an Independent Contractor basis with no taxes deduction. For this reason, you are required to fill out the IRS W-8BEN tax form. Please, be advised that your earnings must be reported to the CRA at the end of the year. You can find the IRS W-8BEN tax form enclosed. Please, email it to me within 2 days since your probation starts to avoid any delays in releasing your paycheck.

Your first paycheck will be transferred via bank transfer, and will be processed at the end of your training (30 days after the first package gets processed) on your scheduled payday, since there might be bonuses or fines (per our Employment Agreement) applied.

Upon the end of your training it will be decided, if you are offered a full time position in our company or not. The evaluation report on your performance will be sent over to our HR Department by your personal manager on the last day of your training and it will take some time to be reviewed by our HR team.

So I started working and eventually got my first order, took pictures of the package, opened it, confirm order and then upload information on the CRM to get the prepaid shipping labels so I can send it. I received 5 packages during the 30 day probation period, which ended on February 25. I got an email from payroll ([email protected]) on Feb 26, 2024 as follow:

"Dear (My name)

Please be aware that your paycheck was handled by bank transfer using the information listed in your below email.

Typically, it takes 3–5 business days for the money to arrive in your account.

Please let me know as soon as you get paid."

And haven't received the payment or any more emails from then as of today March 06, 2024. I tried reaching out to them and nothing. A couple of days after my probation ended, I got 2 invoices, one for $88.91 and the other for $99.79 from FedEX for 2 of the 5 packages. It says "This charge has been rebilled to your account at the request of the original payor". I have contacted FedEX and waiting for a response at this moment.

I was looking for an online position on indeed and came upon this supply associate position. They seemed legit so I went through the phone interview and got the job in the beginning of January. I have been thinking it’s an actual position so I have been donating time everyday checking on the site. I received four packages from them and reshaped them. I have pictures of the contents inside still and receipts of the package shipments. My probation period was over February 14 and I have yet to receive my check and it’s been 20 days. The scammers emailed contacted me for a job offer and upon my accepting the job, I discovered that it was big credit-card, and mailing fraud that entails the fraudsters purchasing goods with the stolen credit-cards and mailing them to my residence.
