I contacted my Bankruptcy attorneys the Monday following that phone conversation and did confirm that "ALL" previous debts, including the one and only Capital One credit card account I had was discharged in the bankruptcy proceedings. I then proceeded to download and print out the entire Bankruptcy discharge from the court which includes the contacts made regarding the discharged debts. All listed right there in plain English for anyone to see.
I decided I was going to wait until tomorrow, Thursday, June 20, 2019 to call ACC back, but,
I then receive a call today (June 19, 2019) from a Mr. Ryan Summers following up on my conversation with Hunter from last week. I proceeded to explain to Ryan that in order to proceed, I would need proof from ACC of the validity of the alleged debt and proof that it was not included on my chapter 7 discharge (knowing full well that ACC could not under any circumstance produce such proof without creating false documents). Ryan explained that they simply saw the chapter 7 discharge and he was even able to quote who my attorney was which is all public information, nothing new there. But Ryan was unable to provide proof (paper proof) that this alleged debt was in fact not included in the bankruptcy proceedings. I requested to see their list of accounts included in my chapter 7 discharge. Again I was told that they could not oblige. Really? I thought that in most collection agency communications they always advise that if you dispute the validity of an alleged debt within 30 days, they will provide information about the original creditor, yadda, yadda, etc., etc. (yeah, okay).
I explained to Mr. Summers that I cannot simply go by his word that this alleged debt is valid and that according to them, first became delinquent back in 2014. I checked my credit report against all closed accounts that were included in the discharge and I clearly see that the one and only Capital One credit card I had back then was closed under Chapter 7. Furthermore, if this account was not included in the bankruptcy and has been delinquent since 2014, then why in the world am I just now hearing about this and being contacted 5 years after the fact?!!! I mean really ACC, c'mon. Who's fool do you take me for?
None, the less, as a one time courtesy, I faxed over my discharge paperwork, blocking out all personally identifiable information of course along with a letter advising them of my dispute of an invalid alleged debt and that should any further action or collection activity continue, I will be initiating and seeking complete legal action against ACC. I further explained that I expect that this matter is closed and void and that their case will be closed out by end of day and that "IF" they required additional information, they can contact my bankruptcy attorney directly and I gave them my attorney's information.
Folks, don't get taken in by collections scammers. Collection agencies are like the bottom of the bucket feeders ([censored] feeders) in the financial world. Banks view these people as nothing more than a nuisance (like gum stuck to the bottom of your shoe) in the financial world. They purchase delinquent debt for pennies on the dollar and then contact you seeking the full payment amount plus interest. Don't get me wrong, if the debt is valid, then you owe it to yourself to settle the debt. But know that you too can settle the debt for cents on the dollar. They will negotiate!!! Just request to see their purchase contract of the bad debt and you can then make a determination of what you can afford to pay.
But if you know that the alleged debt is not valid, or has been paid off, or was discharged in bankruptcy court, or is not yours to begin with, stand your ground and fight against it. The onus is on the collection agency to "PROVE TO YOU" that the debt is valid and collectable. If not, get a hold of your states Attorney General office and put in a complaint against the agency. There are very stiff penalties, up to and including the agency losing their license to conduct business in your state for every contact they make with you concerning an invalid debt, a debt that has already been or is in the process of being settled or has been discharged in bankruptcy.
In this particular case, ACC was "Stupid" enough to purchase a discharged debt. Fools!
Don't get taken in by scammers people. Know your rights off the top.
