I received a flyer in the mail advertising a mortgage restructuring for loans with high interest rates and changes in financial status. I was recently laid off and was a little desperate, so I looked into it. I called the number and had an initial discussion with the company. They referenced funds available under the CARES Act and said I was accepted into the “program.” I did an online search on the company and did not see any negative reviews. The website seemed legitimate. I did not see any red flags at the time and decided to proceed. I talked with a woman named Karen Armstrong and she describe the process to me. I would pay a retainer fee of around $950 to start the process. She passed me off to Bella Gomez who was the processing agent. When the package was complete, I would pay the balance of $1,000. At that point, I was led to believe that the mortgage restructuring was complete. I was contacted when the package was complete and paid the final balance. They were to then send an electronic version and a hard copy in the mail. An electronic version was never sent. When I received the hard copy, I found I was supposed to submit this to the mortgage company to begin the restructuring. I then realized I had paid for a document preparation service and not an actual restructuring. I never would have paid had I known that this was only a document preparation service and there was a risk the restructuring would not go through. I was still optimistic and submitted the package to the mortgage company. I worked with the mortgage company for almost 2 months. Each time I called the mortgage company indicated that this was not how a restructuring occurred, and it was unlikely a restructuring would occur. I remained optimistic and continued the process, but I was ultimately offered a short sale. I contacted American Entitlement Assistance and talked to Marshall Ziegler. He gave me another form to submit. At this point, I realized nothing was going to go through. I had family issues occurring and finally asked for a refund a couple months later. Of course it was denied.

In hindsight, I never received written verification I was accepted into the “program”, and they never indicated that I the restructuring might not happen.

I received several notices in the mail from this scammer. The noticed stated my property was eligible for a special mortgage adjustment program guideline created in conjunction with the 2022 CARES- ACT Homeowner Assistance found or Lender Specific In house Mortgage Adjustment Program. After speaking with Joseph Cruz he said my mortgage would be permanent adjusted to 2% rate for the first 5 years and then 3% for the remainder of the loan. There would be a 2 month grace period without any mortgage payment due. The package would be complete in three weeks, and no prepayment penalty or extension of the loan. I had to give $950 upfront and then the remaining $1000 3wks later before they would send the finalized packet I would send to my mortgage company. They asked for 2 months worth of my bank statements and last years taxes. I did what was asked. My mortgage company simply denied the request. I asked for a refund. They said No but they would consider preparing another packet at no additional cost to me. They also sent a letter wanting my signature a RELEASE OF CONTRACT AND CLARIFICATION OF ADDITIONAL SERVICES. The form states upon them resending a new modification packet no matter the outcome their part of the contract would be fulfilled. They are calling this transaction phase 3. It goes on to release them from all claims,demands,liabilities losses and or requests for additional work to be performed beyond the scope of the Engagement Agreement. Fax number given 12134023682.Instead of continued communication with this fraudgelent company I'm choosing to report my experience to the Bbb to hopefully stop anyone else becoming a victim.
