I signed a contract with Robert Burrell Contracting LLC Olathe on 2/16/2023 for the addition of a room to our house in the place of an existing deck. We paid an advance of 25,329.69 dollar as per the contract. Verbally the contractor, Robert, said he is soon submitting the layout to the city for approval. By the time he will be bringing materials for the work and asked us where to keep them. We never seen him bringing anything as he said. We contacted him every week for the updates and finally March 10th he came to our house with a 3-D projector display of the plan which he mentioned is what to be submitted to the city for approval. Again after 2 weeks, we called him, he said he is going to submit. The week before Easter, end of March, the contractor said he submitted the plan to city a week ago and is waiting for approval. After another 2 weeks on April 14 we called him to know about whether the city approved, which he said did not hear anything. At this point, we decided to call the office of the City of Lenexa and ask what is going on. They told us there is no submission for approval from our home address. We called Robert, the contractor, and told what we heard from city. Immediately his voice tone changed and he said: “I have to call you back, let me call the city”. Then he came to our house with a man named James whom he introduced to us as the person going to do the work, and will start working from Friday April 21st or beginning of next week April24th, while waiting for city’s approval. Robert then apologized and said it was his fault he applied to City of Overland Park instead of City of Lenexa. He said he is sorry that it happened and asked us whether we trusted him. After another week we called city for updates, the city said the contractor was online in the process of submitting but did not complete it yet on April 24th. Tuesday, April 25th Robert called us and said he has exciting news: he submitted the work to city and is waiting for approval. So far James whom he said is starting the work never showed up to work also. Wednesday we called city again, they said, the contractor is still in same page did not submit yet. So my husband called again to Robert, he got upset and said: “I don’t know whom you are talking to, I submitted, maybe they have software issues”. After a week on May 1st we called city back, they said it is still not submitted. We contacted FOX4 problem solver, they suggested us to give a written notice to the contractor to return the money we payed. If he is not paying, to file a complaint to the Johnson County District Attorney on Consumer fraud. We send an email to Robert to return the money, then he replied us saying he got a reply from city saying they are working on the issue. So my husband asked to send a copy of the email from city to us, which he never did.. Finally, my husband told him we cannot work with him anymore because what he says didn’t go with what he is doing . Therefore, we needed a refund of the amount we paid. Robert replied “Let me see what the court says”.
