Appalling customer service and in breach of T&Cs
The consequence was they needed to request significant additional funds. They have rejected the following suggestions:
1) I asked if they could cancel my order and refund part of the original amount, less any administrative costs. Many crowdfunding projects offer this should costs escalate, deducting roughly 15% for admin. This was refused as my order for 3 units had "has already been placed and paid for with our manufacturers" (email 28/09/2022). This goes against what had been said about 'you are not pre-ordering a product' per T&Cs.
2) I asked if they could reallocate these 3 units to retail stock and refund these once they had been sold at profit. This was refused as they "are unable to resell backer units", even though they had "manufactured the amount needed" and "will not have extra" (meaning either they haven't ordered 3 units with the manufacturer and could issue a partial refund if they desired or that they will have 3 unallocated units that they could reallocate if they so chose).
3) I asked if they could send me fewer units, so that what they send would not be below cost price and they would not lose any money, and neither would I. Based on their retail sales price, $139 would still turn a profit on an order of 2 units (not to mention the 3rd unit, which would be reallocated and sold at retail). This was also refused.
The only solution offered has been to find and pay an additional $125 or lose my $139 pledge.
Hitch have acted in breach of Indiegogo's Terms and Conditions and ceased responding to emails as soon as this was pointed out - something also in breech of Indiegogo T&Cs.
In requesting an additional $125 over my original $139 pledge, without offering any alternative, I believe the parts they have fallen short of are:
- When a project is successfully funded, the creator must complete the project and fulfill each reward. Once a creator has done so, they’ve satisfied their obligation to their backers.
- If a creator is unable to complete their project and fulfill rewards, they’ve failed to live up to the basic obligations of this agreement. To right this, they must make every reasonable effort to find another way of bringing the project to the best possible conclusion for backers.
- they work diligently and in good faith to bring the project to the best possible conclusion in a timeframe that’s communicated to backers;
- they offer to return any remaining funds to backers who have not received their reward (in proportion to the amounts pledged), or else explain how those funds will be used to complete the project in some alternate form.
Indiegogo have suggested I pursue legal action.
