This company is charging people surcharges for using their debit cards. After advising them that there are rules and regulations of charging debit cards verses credit cards, they stated they charge both and they will not remove the charge. By law under no circumstances is a merchant to surcharge a debit card. Many merchants believe that debit card transactions authorized by a signature are credit card transactions. This is not true. Debit cards can be authorized by a PIN or by a signature and are still debit card transactions and you cannot add a surcharge fee any debit transaction. The Durbin Amendment was enacted in 2010 to protect consumers from hidden fees. The amendment capped the interchange fees that merchants can charge for debit card transactions. As a result, merchants are not allowed to pass on these fees to consumers in the form of surcharges.
