Type of a scam Online Purchase
On 1/17/18 I noticed a charge of $84.06 on my bank account. I didn’t authorize it so I called my bank and they completed a Disputed Transaction on my card claim.
On 1/24/18 I received a letter from my bank concluding that I had accepted the T&C’s which stated that if I did not contact the merchant within the trial timeframe that I would be automatically billed for the Trial and continue monthly from then.
(now I looked up the order confirmation email I did receive on the order and at the very bottom was a link to “Terms and Conditions”. On about the 6th page I see this: “Negative Option Clause: I UNDERSTAND THAT THIS CONSUMER TRANSACTION INVOLVES A NEGATIVE OPTION, AND THAT I MAY BE LIABLE FOR PAYMENT OF FUTURE GOODS AND SERVICES UNDER THE TERMS OF THIS AGREEMENT FOR $89.05 PER MONTH IF I FAIL TO NOTIFY THE SUPPLIER NOT TO SUPPLY THE GOODS OR SERVICES DESCRIBED. (notice it says “MAY BE . . . “)
Note: When I ordered the product, I don’t remember the main page showing any terms or conditions Nowhere does it say that I am automatically enrolled. Also, I did not receive an email at the time confirming the charge of $84.06 that they processed.
On 1/30/18, I called them 877-577-8331. (intending to return the product and get my money back) Well I talked with a manager who just stood firm on the T&C’s and how they state . . . yada yada. I told her I didn’t open the Clarityx yet & will return it. She said that won’t help. I said that’s unacceptable . . . no change . . . she did give back 35% of what I paid ($29.42) and cancelled my subscription or whatever you call it. Leaving me at a loss of $54.64
Concluding: Any merchant should not be allowed to advertise a product as Free unless it says; “Free trial if you cancel your subscription within 14 days.”
