On February 14, 2017 there was an extremely cheap deal for members that signed up that day. However, as my husband I worked out with our friends, we noticed that there were people (not gym members), buying the equipment and taking it. Some pieces were already missing! Furthermore, the locker room, water fountains, and pool were all shut down as of a few weeks. Basically, anything that used water. As we watched people come in and buy equipment as well as become frustrated by missing equipment that we wanted to use for our work out, we realized that something was definitely wrong. We realized that it must be that the gym is shutting down, when we as members had no idea it was in any risk of shutting down. Our friend asked the front desk guy, Justice, who just sheepishly said “I don’t know”.
The next day, February 15th, our friend said more of the equipment was gone, and there were realtors there looking at the property. KITV had contacted my husband and I after we had posted on the Climb to Fitness LLC page that we may have all been scammed. I was on the 5 and 6 o’clock news on February 16th. The day after that, February 16th, the entire place was bare with wooden boards, empty and dark inside. Had we not put two and two together, or had we not been at the gym on February 14th, we would’ve been even more shocked.
The fact is, we signed up for a year contract, and the contract specifically states under “Buyers Right to Cancel”: “You may also cancel this Agreement if the Home Club moves or goes out of business”. We demand a refund and state there has been a breach of contract.
Since then, many gym members have contacted my husband and I privately sharing different ways that they were either overcharged on their credit card, scammed, or unpaid for their services.
The fact is, we signed up for a year contract, and the contract specifically states under “Buyers Right to Cancel”: “you may also cancel this Agreement if the Home Club moves or goes out of business”. We demand a refund for this scam and sate there has been a breach of contract.
Attached is our credit card statement. You can see at 10/07 the charge was made, and 10/11 it was processed for VOLCANIC CLIMBING HONOLULU.
