I received this email from this "attorney" with Markmastery.com. I tried going to the web site in the email but there was no such site. Also tried calling and that didn't work either. I've contacted my attorney to handle this. Here is the email I received:

"I trust this message finds you well.

This correspondence is from the Legal Department of Mark Mastery.

We wish to inform you of a potential trademark registration concerning the brand name "My Dolly Dearest" originating from a startup business. During our extensive search, your details surfaced in connection with this brand name.

Time is of the essence as another party is also expressing interest in trademarking the same business name. Failure to move forward with your registration may result in them acquiring federal rights, potentially leading to legal repercussions for your continued use of the name. This situation could extend to the point where they could file a case against you and claim ownership of your profits.

As part of our due diligence, we've discovered that your brand is not currently registered with the USPTO. In light of this, we are reaching out to ascertain your intentions regarding the trademark registration of "My Dolly Dearest" Please be advised that, in accordance with the USPTO's first-come, first-served policy, another applicant may proceed with the registration if no objection is raised from your end.

It's crucial to emphasize that, according to the Lanham Act of 1946 (§§ 1051 et seq), federal registration is a prerequisite for securing ownership rights.

Your immediate attention to this matter is essential to safeguard your rights and prevent potential legal complications. We look forward to your prompt response."

This individual sent a threatening email that we were in jeopardy of losing the ability to continue operating under the name of the organization if we did not immediately contact him to resolve the issue. This individual stated they were contacting us because they had an applicant seeking to use the name of my organization and if we did not contact him today, he would proceed with the other applicant, resulting in the loss of ability of my firm to operate under its brand name. Further, the threat of possible litigation was imposed with stated potential penalties ranging from $120,000 to $750,000 if we were found to be guilty of trademark infringement. This was an attempt to solicit services through scare tactics. Unbeknownst to this individual, the name of the organization was already trade marked. Further, the individual identifies themself as an Intellectual Property Attorney, but there is no record of him as being a member of the New York Bar Association via its online Attorney index. That would potentially constitute practicing law without a license. While I do not begrudge someone seeking new clients, the manner in which this organization goes about doing so is predatory and threatening and needs to be addressed.
