I am a restaurant equipment reseller and run my company remotely. On September 20, 2023, a customer introduced himself to me over sms (via phone number +1 (506) 703-5435) as Juan Lopez, owner of Elizabeth Restaurant from 5622 Lemmon Ave, Dallas, Texas, and gave me the following email address: [email protected]. I used the said email address to send him invoices via QuickBooks for his orders.

Juan Lopez ordered 4 units of equipment (refrigerators) from yours truly, involving 3 purchase orders over 2 days and 1 vendor from which I sourced the equipment, Turbo Air. These totaled to $ 21,076.29.

Juan Lopez picked up the units on the same day he had ordered them from us (Sept. 20 and 21, 2023). He always wanted to pick up on the same day he ordered the items, which is not the usual SOP I have with my customers. The one who picked up the units signed the packing list as "Dominguez" upon release of the said units. He only used a Home Depot rental truck and had no ropes to secure the huge equipment.

The check payment for $21,076.29. of the account holder was received on September 25, 2023 after a QuickBooks invoice of the same amount was sent to [email protected]. The customer paid by clicking on a link in the QB invoice I sent him.

However, it appeared that the check payment did not successfully transfer into my account. I've notified the customer via sms repeatedly over the failed transactions for each purchase order and he did try and resolve the issues by resending the check payment. However, once all the equipment he ordered from me was picked up, the customer filed a dispute and got the check returned. As a result, the payment was withdrawn from my bank account.

When followed up on payment via sms or email, the customer no longer responded.

Later, he introduced himself as Jonas Peralta to my sales executive, ***** *****, and attempted to order similar items on Sept. 27, 2023. He used the same phone number and email address as his "Juan Lopez" identity. This is how I was able to determine that Jonas Peralta was the same customer as Juan Lopez. We asked the customer to settle the dues and he agreed. But the payment he arranged for, just like his previous ones, was eventually not successful. Subsequent follow ups with Juan Lopez / Jonas Peralta did not earn any response from him.

This had been confusing to me as the customer had already picked up the units paid for by the check. The items are already in his possession yet the payment has not been credited to my account. There always is a "returned check" or dispute filing involved on the customer's end even though he had great feedback after he received the equipment I sold him.

With the disputes, it seems I am being made to appear to be the questionable party, which is unfortunate as I am the one who incurred a loss from the suspension of the check payment of the customer. This transaction would have never moved forward if the customer/account holder did not independently, voluntarily and knowingly approve and send payment through QuickBooks.

On October 9, 2023, Juan Lopez once again contacted me via WhatsApp for another order. He agreed to pay the outstanding order and sent a check payment of $37,392.80 that covered the outstanding balance plus the current order. After he picked up the units 2 days after paying (Oct. 11), the check payment was again disputed and charged back to me on Oct. 13th.
