A Texas Natural Gas Company offers home essential systems protection plans for its customers with HomeServe. I signed up and called HomeServe due to a loud noise coming from my A/C unit outside (which I had heard before in the first year living in my newly built townhome). HomeServe sent J Winkelmann, who was dressed in a professional attire and another man came with him who was dressed as a HVAC repair worker, less professional attire. After introducing themselves, they both said they’re going to check my outside unit and it appeared they attached some sort of a device on the unit in my backyard and disappeared for several hours. When they knocked back on my door to provide me their initial report, they said my system was broken and had to be replaced. They then spent several more hours in my home and my attic and on their phone. I overheard their conversation and they were establishing a quote for an entire new system with all the bells and whistles for $38,000.00. I told them I was not interested in anything that expensive and couldn’t afford it anyway. They continued to collaborate with their partners on the phone and lowered the estimate to around $34,000.00, I again refused and informed them I had had enough, was tired & their overpriced system wasn’t going to work for me and I needed to eat and get some rest. J Winkelmann (JW) and his co-worker pressured me into giving them another chance and said they would rework the estimate and come back in the morning; however, they needed to do a credit check before they could proceed. JW insisted he would NOT see my Social Security number and it was completely confidential, in fact he said he would not watch as I typed my social security number in his iPad using his stylus pen. I hesitated to do this and although I knew my A/C was NOT broken, I knew from previous experiences with it, it wasn’t going to be long before it did go completely out and due to health issues and my age, I couldn’t afford to be without Air Conditioning. So, I wanted an estimate at least and hoped they would return in the morning with a workable estimate. I also have credit file locks and extended fraud alerts on my credit files due to prior fraud and identity theft issues and told them this & I felt they would NOT likely be able to do anything until I unlocked my credit files, which I did NOT do. After they left, I felt I was completely taken advantage of due to my vulnerable situation, being a Senior Citizen, and being a female living alone. I was blindsided and felt I was targeted and scammed into providing my personal and private information using his stylus pen on his iPad, despite the locks and fraud alerts on my credit files. My elderly, febrile 86 year old Father came over next morning and stayed during the second meeting and told JW outright that Finch has a bad reputation and is way overpriced. This was the first I had heard about Finch’s reputation and I was not sure what to think until JW’s quote came down to something around $13,000 00. So, needless to say by the end of this meeting, I knew something was seriously wrong and I told JW that I was NOT interested and he soon left.

Although I noticed he had the old school carbon copy contracts in his possession the previous day, he put them in his briefcase and I never saw them again. I was never provided any paperwork, nor asked to sign anything, except on his ipad, providing my personal information the previous day including my Social Security number, name and address. The female Supervisor on JW’s speakerphone told me they use TransUnion and that they were unable to obtain my credit score due to it being locked. Nevertheless, JW still continued to pursue me and try to get me to buy their new system and he came alone the next morning with the quote that was literally 25,000.00 less than the original quote the day before. About 15 to 20 minutes after JW left, he returned, knocked on my door and I opened it and he barged his way inside and just stood there inside my home, by the doorway. My Father and I were both trying to figure out what was going on and why’d returned looking so different less than half an hour before. Since I wasn’t expecting him nor his bombarding intrusion into my house, appearing disheveled with a red flushed and sweaty face. And his and his demeanor had completely changed as well. He finally insisted that he could not leave until I signed two things on his iPad: one signature was that I allowed him in my home, and the second was that he did NOT break or take anything from my home. I told him I was not comfortable doing that and he wouldn’t leave nor budge. He kept shoving his iPad at me to sign and the two places I signed did NOT say anything about what he said it said. Both places were nothing more than a few sentences, in fine print, that usually appear beneath any document whereby a person signs their name. I kept asking for a copy and he said they were emailed to me. I never received the documents I signed, instead I was emailed multiple documents with prices and quotes and as I was trying to pull up and view all of the documents that were sent as attachments, I was locked out of my email account and have never been able to retrieve or view them since. I called the Finch Supervisor and informed her of this and asked that she send me certified copies of all the documents that I signed or didn’t sign and informed her that the documents I was able to see were not what I signed on JW’s iPad.

She argued with me for quite sometime and finally agreed to mail me hard paper copies of everything I signed, certified mail and she would mail them to me that day. I also told her that I rescind every thing I signed or didn’t sign. I have never received any documents or mail from Finch-Service Experts. I have never been able to unlock or retrieve the encrypted emails or attachments that were sent to me by them. I have tried to unlock them, contacted my email address provider and have not had any luck. I reported this to CenterPoint Energy and have a case number if needed. I fear this company and possibly the company that sent them to my home for the service call have the potential to do things that I am not even aware of. Finch-Service Experts could try and do illegal things that can affect my personal finances/property. Please let me know that you received this report and what you can do to obtain the information that was never sent to me and any other assurances and assistance you can provide would be greatly appreciated. I want to prevent this from happening to anyone else, especially the elderly and vulnerable communities.
