Congratulations… Foxworth Marketing Company is very pleased to notify you that a settlement of Collective Action aka Class Action charging fraudulent sales tactics, unfair pricing and inventory malfeasances has been reached against Ecotourismo De Bahia De Banderas S De RL De C.V. Puerto Bahia Villas and Spa aka The Private Residence Luxury Club Et. Al in La Cruz de Huanacaxtle, Nayarit, Mexico, in the amount of 16.3 million dollars. Because of your date of purchase, you had previously been chosen to opt into this collective action rendering you as plaintiff for a substantial monetary refund of your purchase price.
On March 5th, 2018, Jalisco Magistrate Jose De Jesus Lopez Arias deemed Puerto Bahia aka The Private Residence Luxury Club liable for refunding all requesting members who purchased memberships between the dates of January 1st, 2011 and July 31st, 2014.The court ordered a 19.2% interest to be paid in addition to the purchase price, not as punitive damages, but solely as interest on money held for the time frame in review.
Be advised you have the right to keep your membership intact and not receive your court ordered refund. Members who do not wish to terminate their memberships and receive the courts compensation may do so by responding to this notification and stating they wish to keep their membership intact. All due compensation of those members will be reimbursed to Puerto Bahia aka The Private Luxury Residence Club Et. Al. by the courts and deducted from the total verdict amount as part of due process. Those who wish to avail themselves of the benchmark verdict and receive their court ordered compensation need only respond to this notification by phone or e-mail stating they wish to receive compensation and we will then send you all the documentation and forms needed to accommodate your refund.
As matter of course, once refunded your court approved settlement, all of your membership rights to the above mentioned resort will be revoked and any and all financial responsibilities to the above mentioned resort, ie.maintenance fees, monthly payments, etc., shall be suspended and terminated. Upon receiving this email we ran several searches for this company and Mr. Fontana in the Phoenix, AZ area but could not find any company listed under this name. We immediately felt this was a scam. Close friends of ours here in Florida also received the same email. We felt it was important for us to contact the ScamPulse.com in Phoenix to make you aware of this possible scam. We also at a lost to understand how they received our contact information. Thank you for any help you can provide.
