Type of a scam Investment
During the call, Brian stated the actual consulting engagement cost was $32,000, but he would self-fund the majority at $22,000. For us to enter into the agreement, we needed to wire him $10,000. Brian made a series of calls asking when he would receive the wire for his partners to start their funding process.
Within his comments, Brian Kely asked if I was a spiritual person. Replying “Yes,” Brian Kelly proclaimed, “I have been sent by the Lord to be his intervention to help you receive funding.” After receipt of my $10,000, subsequent conversations asking about his progress or success were related with repeated expletives, often using God's name in profane manner, as part of our discussion.
He informed me that upon receipt of our $10,000, his partners would be sending 12 additional questions they would need to complete our biotech funding file. Over the following 30 days, he asked if I had received them. Upon each ask, I replied “no one has contacted me, nor have I received any questionnaire.”
I never received any questions nor was it confirmed to me by Brian Kelly that he had paid his commitment of $22,000 to fully engage the funding process.
Brian Kelly said he would remind them again to send it out but stated “you do not need to answer all if not relative.” No questions were ever received. The investor types he claimed contacted on our behalf were bogus. The names were cut and pasted from a database and had no relevance to our biotech venture. His very sporadic comminutions regarding my concerns resulting in referring me to another person, who was not an investor. Brian Kelly stated he had raised $10 million for this person and owed him for his previous help.
Excerpted from my financial fraude and wire fraud filiing with the Office of the FL Attorney General, in part it read:
Initiating our own fraud investigation, we discovered (1) the RE building management firm for the Pensacola office he claimed for the past 7 years, had not record of Brian Kelly or Hallmark Capital Partners, (2) citing 4 employees, none lived in Pensacola as his website cited, (3) his claim to be a Wharton graduate could not be confirmed by the university, (4) an office in Las Vegas was allegedly staffed by a local PhD partner. The person lives in San Diego and is not associated due to working for another company, (5) another alleged employee lives in Atlanta and was not associated, (6) Brian Kelley did introduce is to one person who was not an investor but someone to give him cover for working on our behalf, (7) he uses several phone numbers, some cell and VOIP as office contact numbers, (8) his personal cell is actually in his father's name, (9) requesting background information on his activities as to who was contacted, when, what was discussed and what documents of ours were provided, he never responded to several required emails, (10) In March, I receive an email he characterized as being a 17th century type context and I should understand that his expenses were now 50% my responsibility, (11) he now refers to a new office located at 3 Portofino Drive, in Pensacola Beach. This is a multi-tower site complex and resort hotel, (12) the telephone number used is 702-970-4780, (13) a universal telco search revealed “no match found or owner”. (13) when referring to his firm, he uses the non-existent employees, that do not live in or work at 220 W Garden St, Pensacola, FL over the past 7 years, (14) he claimed his firm was started in 2007.
