The carbon filter suddenly broke down and the plaintiff reached out to have the issue resolved. The plaintiff realized that the company had no professional website or email attached to the contract. Rather the plaintiff was left with a Google mail account to contact the company with and a phone number that was never responded to. After numerous emails, calls and voicemails were left unanswered, the plaintiff decided to contact the Ontario Consumer Protection Agency of Ontario to administer a claim on the company, as the services the plaintiff paid for were no longer being rendered.
The Ontario Consumer Protection Agency recommended that these service companies were being investigated for fraudulent behaviour and that if there is no contact with the company, to cancel the authorized monthly payments through the plaintiff’s financial institution. Upon cancellation, Trusted Home Services failed to reach out to investigate the stop payments, nor did they reach out to resolve the initial issue with the failure of their services and products.
Approximately two and a half years later, Solomon Jones LLP contacted the plaintiff to suggest that there is a lien on the plaintiff’s property for the outstanding unpaid amounts, including legal fees from Solomon Jones LLP, totalling $4,606.34 for one contract, and $20,210.62 for another contract. These amounts were calculated on a basis of a 34.489% per annum interest fee on the stopped payments.
The plaintiff would like to file a lawsuit against the company for the unrealistic amounts being requested to be paid out. The plaintiff stopped the payments due to the fact that there was no resolution to the services no longer being rendered and with that, decided to stop payments due to the unresponsiveness of the company. No one reached out to resolve the issue, nor did they contact the plaintiff once payments were stopped.
This is not the first incident of a situation like this for Trusted Home Services. Upon further investigation of the company, the plaintiff noticed that a large amount of people had experienced the same issues and are still awaiting refunds from the company for services unrendered or have lost large amounts of money due to the company’s dishonesty and malpractice.
