My elderly wife who is suffering from dementia received a call from a Linda Miller on 8/25/17. This woman's number was a private unlisted one. Ms Miller told my wife that she was a process server getting ready to serve papers immediately on my wife for a law suit. She directed my wife to call the phone number 855-707-6649 then and there to get help resolving this law suit. After my wife inquired Ms Miller told her that this was the number of a law firm who could assist her with her dire situation. As it was 4:50 pm, our time on the east coast, she said my wife had to call immediately as this office would be closing at 5 pm. Upon research later I realized they were calling from California and the time was 3 hours earlier (nowhere near the 5 pm closing time she had told my wife). My panicked and confused wife called this number which was answered by a Michael Benjamin who began telling her that she had an outstanding debt from a bank credit card from 2005 and she would be taken to court if she did not work with him to resolve this debt. He would only give her the name and the last 4 digits of the credit card in question. We had never had this credit card.

Due to my wife's cognitive disability I handle all of our finances and had long ago paid off all of our credit card debt. We had never received any correspondence from this bank about having any credit card with them or outstanding credit debt. We also had, for other reasons, filed for chapter 7 bankruptcy after the time of this supposed credit card debt and were completely debt free. When I came into the room and saw my frantic wife on the phone I had her tell this Mr Benjamin person that she would give him permission to talk with me. He agreed to this with her but when I took the phone he was rude and abrasive, obviously unhappy to talk with someone he could not bully. He refused to give me any corroborating information about this credit card nor would he agree to mail us any paperwork so I could review this alleged credit card default information against my wife. He continued to be angry and irate with me refusing to explain any further details about this situation. I finally had to hang up on him.

In searching online I have found numerous complaints against this Michael Benjamin and his associates at Kenwood and Associates in Riverside, California. Most of these complaints told of similar bullying calls from and treatment by him or his associates at this business. People were told they were about to be served with papers immediately and taken to court due to nonexistent credit card debt which Mr Benjamin, et al could help them resolve. I wish they had complained to the BBB but most were at a site listing scams and maltreatment from this phone number. Can anything be done about Mr Michael Benjamin's and his associates inappropriate actions?
