Hugo Dias from HDIAS Painting presented himself to me as a contractor and offered to take over a complete remodel of my kitchen. He took $15,000, demolished my kitchen and never delivered the project. I have been left without a kitchen, cabinets, granite, and everything else since August. I will attempt to share concise bullet points of all important information. I have proof of everything I will share.

- On June 1, I paid Hugo $3,500 as an initial payment for the project. We agreed on terms and date of completion. The work was supposed to be completed from Aug 14 to Sept 1.

- On July 28, Hugo asked for money to order the materials for the project, including cabinets and granite. I paid him $6,500.

- On Aug 14, Hugo and his helpers showed up, they did not have a dumpster available on time so they delayed the beginning of the project

- On Aug 21, they demolished my kitchen. During that week they also removed the old tile and installed the new one.

- On Aug 23, while his team was actively tearing down my kitchen, Hugo asked for additional money to pay for their work and pick up the cabinets. I paid $5,000.

- On Sept 1, the cabinets Hugo claimed to have ordered from Home Depot were due to be delivered (Note: this was already the day the project was due, as seen on the invoice). Hugo stopped replying to my questions about the time of delivery and did not communicate with me for 4 days.

-From September 5 on, Hugo's communication became extremely short and with no real content. I began to ask for specific dates for the delivery of the cabinets and completion of the project, I asked for proof of purchases or concrete answers regarding the completion of the job and he continually refused to give any of that information to me. He began to ghost me, going up to 9 days without any replies to my messages and attempts to call. Hugo and his workers stopped coming into my house shortly after the tiles were installed on week one of the actual work. Hugo claimed that Home Depot was delayed with the order of the cabinets, he claimed that he lost money in the cancellation of the cabinets to order elsewhere. (Note: During his longest ghosting spell, of 9 days, I called 7 Home Depots between Springville and SLC to ask for the status of the order, all of them confirmed that an order was never placed under either my name, his name, his business name or phone number. I do not have recordings of these calls except for a screenshot of the numbers dialed, which I can provide if needed)

-On Sept 18 Hugo began saying he was running after a new cabinet company to place a new order. He delayed the measurements and the "placement" of the order for weeks. Finally, after a lot of pressure, on Oct 9 he gave me written confirmation that new cabinets had been ordered and would arrive between 2-3 weeks, with the latest deadline of Oct 27.

-The week the cabinets were due, I started to become anxious, given the repeated pattern of no delivery. I asked him multiple times for the name and number of where he ordered them so I could call and confirm the delivery date. He refused to give me the information.

-From Oct 24th on, two days before delivery, Hugo began to ghost me again.

-On Oct 27th, the date of claimed delivery of cabinets, I was still being ghosted by him, so at 1 pm, I sent him a message saying that if I didn't hear from him by 5 pm the contract would be voided and I would pursue legal action. He replied just saying that he would call me back later, but promised that my kitchen would be finished by Thanksgiving.

- On Oct 30th, Hugo said he was headed to pick up the cabinets. He never got back to me.

-On Nov 2 he said they would bring the cabinets to my house Saturday, on Nov 4.

I spent the weekend of November 4th waiting for him for the last time. He began ghosting me again.

-On Monday, Nov 6th I sent him a text saying I needed to speak with him urgently by 11am, I messaged several time and attempted to call several times with no reply again (He had been ghosting me since the last promise of delivery). That afternoon I submitted a claim with DOPL and with the Department of Consumer Services.

-On Tuesday, Nov 7th I made a post on my Facebook page telling the story of what was happening, I tagged him and his company. Hugo, who had been "without service" and unable to reply to my messages for 4 days, replied to my post within minutes and reached out to me to delete my post.

-I was assigned an investigator by DOPL, who reached out to Hugo and cited him for working without a license. I was assigned an investigator by DCP who also reached out to Hugo.

A contractor reached out to me and offered to take over the project, he said he would do the work for free if I could get the material, he knew Hugo so he proposed to take over the project and Hugo would just have to pay us back all the money or purchase all the material. We communicated that plan to the investigators, the investigator from DCP said he would keep the case open until Hugo pays back.

The investigators, the new contractor and I have been positioning to Hugo the expectations of needing to have the money paid back by Nov 17th. Hugo began to attempt to negotiate back saying he could only pay for the cabinets by that time, without a forceable, concrete timeline of returning my money.

-On Wed, Nov 8th, I emailed Hugo and the new contractor in a group message to make sure we were aligned in agreement. I expressed that Eddie (the new contractor) would be starting to get quotes and place orders on Thursday at 10am. We needed Hugo to confirm if the cabinets he claimed to be ready for pickup actually existed, otherwise, he would be responsible for paying for additional cabinets and any other "duplicate" materials purchased. He did not provide any information back, confirming that he had lied about this order as well.

I am desperate, I had to start paying for materials for the kitchen to be finally put together again, but I am having to put everything in credit cards because he took my money.
