I received a call from a Arizona number, looked up and is a cell phone, and had the same message pretty much word for word except they used my county, had my address, but the girl said "good afternoon " and it was 8:40 am. Gave me same number as above complaints of 866-424-5865 and gave me a 7 digit file number. The person sounded legit except that it's not afternoon for 1 and secondly if I was having a civil suit filed against me, I would have received previous warnings and paperwork in the mail. The girl stated that she was a clerk at DS services. There is no DS services in Arizona. The number the girl called from was 623-309-5281 and she stated her name was Andrea Gil.

I believe these calls are from a collection agency that purchased written off credit card debt. I think some of these were Providian Credit Cards that was taken over by Washington Mutual in early 2000 but continued to use the Providian Name. Then in 2008 Washington Mutual failed and Chase Purchased the assets and assumed debt in the bank bailout. But Chase did not acquire any debt that had already been written off. I think this is the debt someone has now acquired and is attempting to collect by making threats of a lawsuit that in most if not all states has gone past the statute of limitations. First, if someone is going to file a lawsuit they don't need to contact you first but a process server is not going to call you if a lawsuit has been or is being filed, because they need to serve you with the summons and alerting you might make it more difficult to serve. And no lawsuit needs someone to sign for the summons.
So I think the treat of a lawsuit in an attempt to get you to pay a debt that is not collectable. I understand these guys will also contact your work, relatives claiming that a lawsuit has been filed in hopes one of those individuals offers to pay the debt.

Just heard a voicemail from yesterday with the same info. They threatened if I didn’t call back, they would file a lawsuit or legal action would proceed by the end of the day.

1) they would need to send written warning to do such a thing - they don’t just move forward by the end of the day with the voicemail
2) it was a good phishing attempt because they found some local American with a good accent that makes it sound legitimate - so be careful. Usually, it’s an Indian doing this. They’re getting better.

The scammer said that they represented a Law firm that was proceeding with a lawsuit. Please call 866-424-5865 with a reference #. (7 digit reference #)

Thank goodness you posted this, I dont know where they have the nerve to reach out to my mother's cell phone and tell her to relay the message with the same exact script you stated " word for word" above. it's disgusting.
