Type of a scam Debt Collections
I immediately called 866-826-7627. This number belongs to a company calling themselves MSM Legal & Financial Services (MSM). After being transferred to a supposed attorney, I was told that this matter concerned a debt for a Credit Card. The attorney stated that the charge off date for this debt was in 2015. I informed him that this date was wrong and that this debt is long past the statute of limitations.
I informed the supposed attorney that I have a copy of my Credit Report. The Credit Report clearly shows that the debt charge off date was in 2009. More importantly, the last payment was made on 2008 (10 years ago). The date of removal from the Credit Report was in 2015. Thus, the item had been removed since 2015.
I also informed the supposed attorney that the debt occurred in a state where the statute of limitations is 5 years. I now live in a different state. The statute of limitations in my current state is 4 years. Thus, no matter which state law is applied, this debt is time-barred from any form of legal action. When I explained this to the supposed attorney, he said that they would still seek legal action and hung up the phone. Of course, I never received any actual court documents of any type after this call.
I have retained the voicemail left by the supposed County Dispatcher. Upon researching, it appears that the phone number used by this supposed County Dispatcher is a fax line for an actual Court. But, there is no pending litigation of any type.
Nevertheless, in accordance with the FDCPA, a debt collector violates the Act when they take legal action or threaten to take legal action on a debt that is time-barred. And, in accordance with Court decisions such as Freyermuth v. Credit Bureau Services., 248 F.3d 767 (8th Cir. 2001), even the Court has recognized that it is a violation when there is a threat or filing of litigation for debt that is time-barred.
MSM Legal and Financial Services appears to be a scam debt collector that utilizes phone number masking software to make it appear as though they are calling from a local Court. During the call, they threaten legal action and tell you to call 866-826-7627 with a reference number. Once you call, you will be threatened again with legal action unless you pay.
