In my case I purshased a vehicle and was told it was a one owner vehicle with no known issues, and already passed emissions. At the time of purchase the car had no check engine light on. The next day the car started having issues and the check engine light came on. I took it to be diagnosed by a mechanic and was told both catalytic converters needed replaced and a knock sensor totalling $3,000. He said someone must have cleared the check engine light and somehow falsified the emissions inspection. He suggested I return it and file a complaint.
The unusual part to this story is, I happened to open the glove box and found a bill of sale to another lady from a few months earlier. Her number was on the paperwork so I reached out to Her. She gave me a statement that She had major issues with the car and had to fight with them to return it. They eventually agreed to take it back if she gave them even more money for a different vehicle.
So I have proof they were aware of the vehicles substantial issues, never attempted to have it repaired or disclosed the history.
I contacted the dealership with my attorney after the weekend for a total of 4 days after purchase to return it and they refused, and instead said "as is" call the police.
So that is what I did, I explained the entire situation to Ogden police officer **** ***** with fraud investigation. Unfortunately He wouldn't file a report explaining the DA's office wouldn't follow up. Instead He suggested I file a complaint with ***** ******* from the DMV overseeing car dealer licenses. I have now submitted all my evidence to them, my bill of sale, the bill of sale of the lady that previously returned it, along with Her statement, copy of the mechanics $3,000 estimate, copy of dealerships add falsely claiming no know issues and passing emissions.
I paid $5,465 for the 2010 Ford Fusion investing another $3,000 isn't possible for me so now I am still waiting on some type of resolution. I am also hoping that I can discourage this dealer from these fraudulent practices in the future or potentially lose their dealer license.
