Hello:

I responded to an ad for an apartment listing for 180 Montague St. Brooklyn, NY posted by a Philip Gatton.

After emailing back and forth I forwarded to him a signed lease document, a security and 1st month rent deposit to the listed information on the lease he provided totalling $3,400.00 USD. After confirmation of receiving the lease, a few weeks later he sent me a follow-up email requesting another $3,400.00USD. I refused. A few days later he sent an email stating that he needs to replace the heater in apartment and it will cost $1,700USD. Again, I refused. Upon my arrival to Brooklyn, NY landlord requested a $100 iTunes giftcard to "print documents." My husband and I refused. We went to the local police deparment in 84th precint Brooklyn, NY and they told us there is nothing that can be done. I notified my bank of the fraud and filed a claim. i received a call from my lawyer this morning concerning the previous transfer you made. she said the transfer

is too small to know your financial ability to rent my Apartment.Moreover,my lawyer has an interested candidate that wanted to rent my apartment and ready to pay for the 6 months upfront but i disagreed because of your sincere interest in my Apartment and the apartment has been reserved for you already. however,my lawyer ask me to inform you that you should proceed with the transfer of 2 months rent in other to confirm with the previous transfer you made. and you don't have to pay for the rest 3 months when you move in and if you decide not to stay in the apartment any longer, i will return the your full payment back to you. am so sorry for any inconveniences. kindly let me know when you get the this done.

Hello Mr. Gatton:

Per the contract I signed, it was requested that $3,400.00 be submitted as proof that I can financially afford the $1,700 monthly rent. Therefore, that amount was transferred to M(r)s. Susana Quintero's account as requested and thus I was informed by you that the $3,400 deposit was confirmed and that the apartment (180 Montague St. Apt. 01-12B, Brooklyn, NY 11201) was reserved for my move-in date of Thursday, October 26, 2017.

That being said, my husband and I are not willing to go outside agreed contract terms that I signed in regards to this new request made by your lawyer to send an additional $3,400 (the equivalent of 2 months rent).

Therefore, we are requesting that the full $3,400.00 be returned to us at this time. Thank you.

Hello,

I can understand your point of view regarding been secure with all payments, at this stage I need you understand the apartment is fully reserved for you so I went to check through the apartment with my lawyer yesterday to confirm all appliances and heater are working fine but on getting there I need replace or fix the heater and replace some kitchen appliances today or tomorrow, I would appreciate if you could pay a month rent more for me to fix all this and I will issue you receipt which signifies you already pay 2 months rent upfront.. I always want my tenant in best condition and comfort, it's already winter time and you need much of heat source this time..

I received your request.

In all my years of renting, I have never heard of such a request being made to me before.

I am not sure if that is something that is usually done in NY and not here in FL.Therefore, I reached out to the Brooklyn Housing Association. After speaking to a Brooklyn Housing Association personnel, I was advised that this request cannot be made legally as any maintenance work that needs to be done prior to moving in or that is requested secondary to normal use is not the tenant's responsibility but the landlord's.

Thus, I am going to decline this request.

As such, if the apartment cannot be made ready to habitable living conditions according to NY housing state laws by move-in-date, I would just appreciate that this information is made known to me so that I can be issued a refund, this agreement be annulled so that I can quickly find another living quarter as I am a few days out to relocating to NY.

However, if the apartment quarter can be made ready by move-in date, I would really like to just abide by the boundaries of the signed lease agreement.

Landlord never responded to this email. Upon my arrival to NY I notified him and he stated that he will be on his way but asked for a $100 iTunes gift card so that he can "print documents" upon arriving at the apt location. We refused and he never showed.

Since then, we became very suspicious and spoke to the concierge personnel who informed us that he has been at the location for 2yrs and there is no one by that name who owns/rent apts here. In additon, the apartment of question (180 Montague St. #01-12B) was already currently being leased to another tenant. Phillip Gatton continued to harass us for the iTunes gift card and never showed. We then presented to the Brooklyn police precint #84 who told us there is nothing they can do.

I also notified by bank of the occurance to see if funds can be recovered.

Since then, this person has continually been harassing us for additional money.

In additon, upon checking a google search online ([email protected] nyc), this Phillip Gatton has multiple listings using same apt pcitures found on ForRent.com with different phone numbers but same email such as this website: (https://www.beycome.com/print-flyer/flyer-property/4023), (http://www.ft2.com/Roommates/Washington/apartment_10281.htm#listingDetails4).
