Hi there, in 2022 I hired a company called Pinnacle Trademark to file a trademark for my business. They filed both applications for me and I haven't heard anything about it since 2022. Yesterday, they reached out via email stating that they had correspondence from USPTO stating that my application was on hold due to Section 8, 9, 15 and needing an affidavit for each class totaling $8,100. I called them and asked for more information. I spoke with "Henry Johnson", my attorney with Pinnacle Trademark. When I asked more questions, the "attorney" suggested we call the USPTO directly. He called what I thought was USPTO and got in touch with the "representative" in charge of my cases. The USPTO "rep" informed me that others were trying to file the same trademark as me after discovering that I had filed, and that I needed to prove I was the first one using this name from 2011 and that in order to proceed, I would need to pay the $8,100 for Section 8, 9, 15 and the affidavit or expose myself to being sued for using the name. They then sent an email with wiring instruction for the funds to be paid to them. I called the USPTO afterwards only to find out that my application is still in process and has not been assigned to an investigator yet and that they never sent the attached correspondence. There are also reviews from other people on Google that the same things happened to them. So apparently this company has created a front wherein they will file the applications for you (so they must have an actual attorney on staff or a made-up attorney?), then turn around and fabricate issues that require additional fees to be paid to the USPTO and even posing as USPTO reps. I am not sure how they have managed to stay in business this long, but they have. I figured I would bring this to your attention to maybe you can stop taking applications from this company thereby preventing anyone else from being scammed. I have a fraudulent document from them from the USPTO as well. If you have any other questions, please let me know.
