This company contacted me via email stating that another company was attempting to trademark my business name out of North Carolina. They were going to take my business name and could sue me. They claimed they did my logo (claimed owned multiple logo companies). I stupidly paid the initial and they said that's all that I would have to pay them and no further payments to USPTO either. Heard nothing for months and suddenly in May of 2023 they contacted me again stating I had to pay thousands to finish the process. I gave push back and questioned everything. They did not respond back at all and suddenly in November I get texts from random numbers claiming to be them and saying I am going to loss my business name. I demanded proof of this supposed person who was trying to trademark my name. Took her a while and she sent me bogus document with some random persons information. Now this document says the person is from Michigan not North Carolina. I continued to questioned it and she starts calling me. As soon as I heard her voice over the phone I knew I was speaking to someone in another country. This person isn't even in USA. It's all scam.

I contracted with Pixels Logo Design in 2018 to create my company logo, and I don't have any complaint about that. I paid a fair price, and received a product in a timely manner, and they made the alterations I requested also in a timely manner. In late 2021 I was contacted by their 'paralegal team', and notified 'as a courtesy', that another company with the same name was attempting to use their services to Trade mark their logo, and that they were giving me an opportunity to allow them to register it first, since I was an earlier client. I will never know if that was true or not, but after talking to the US Patent Office, I now know that I paid far more than I needed to. I chalk that up to my own ignorance, and lesson learned. They actually did file the application with the patent office, so the trade mark is in process. The scam came this year when they contacted me claiming to be the patent office, and using the name of a high-ranking department head at the US Patent Office (Amy Cotton), to tell me that the other company using my company name, that attempted to file their TM application with Pixels', had registered an appeal with the patent office to re-evaluate the case that they were actually entitled to use my company name. I was informed that I had two choices - pay about $6,000 in fees to fight the case, which I had a certainty to win, or drop it and pay $8000 or $9000 in penalties and attorney fees to the other company. Thankfully, I called the US Patent Office Fraud Prevention department and talked to them, and they explained that none of this supposed activity was happening - that my application was still in-process and hadn't even been reviewed by their in-house legal team. After all of this, my impression of Pixels Logo Design, is that they are a semi-legitimate company, that does a really good job at taking advantage of their clients who are not familiar with the patenting process, and downright defrauding some of their customers. I would highly suggest you look elsewhere for any services. At least some of them are literally out to steal from you - I now know this from personal experience as an undeniable fact. I have text messages and voicemails to back some of this up, if they would like to claim this is false. By the way, they went so far as to set up a fake automated phone service that they copied from the US Patent Office, to further lend legitimacy to their scam. If they put as much effort into their scam as they did into their legitimate business, it would probably be thriving.

I purchased a logo for my business from Pixels Logo Design in 2017. I was contacted by Ashely Quinn (415-463-7443) from Pixels on October 16, 2021, saying that they had received an application from someone in North Carolina for the same business name as mine. She said trademark registration is provided on a first-come-first-served basis and she was offering me the courtesy to choose if I wanted to trademark my business name or Pixels would proceed with the application for the other applicant.

I asked several questions and emailed with Ashley and the following people:

Elsa Adams (706) 606-0039

Isabella Frost

Neel Foster

I sent $499 for the trademark application. I trusted them because I had done business with them in the past.

Then, on November 3, 2021, I was contacted by Emmanuel (415) 949-5519 and told that I now had to pay $500 for the two assigned classes for my trademark. I was told that these were required federal fees from the USPTO. I paid $500 and was notified by Emmanuel on November 13 that my application had been successfully filed with USPTO.

On April 22, 2022, I received a phone call from Mark Freeman ([email protected]) and a follow-up email stating that I now had to pay federal fees of $1400. From April 22 to May 5, I received almost daily emails and/or phone calls saying that if I didn't submit the fees, they would move forward with the other applicant who would then take my business name. I asked for proof that my application had been submitted to USPTO and they refused to provide it unless I paid the $1400.

That request led to my discovery that others had been contacted by Pixels Logo Design with the same trademark threat. I have also reported them to the Federal Trade Commission. This company took $999 from my small business (which is just me) and I received nothing from them.

My last email from Mark Freeman:

"I hope you understand that there multiple fees involved in this process such as, attorney's fee, filing and handling, monitoring and maintenance, etc.

This is a thorough process and this registration is for 10 years of time for the entire US?? Do you really think that this can be covered in only $1000? Also, you have been asked for the fee that needs to be paid so we can get the registration finalized. And if you remember, you were dealing with a trademark infringement case as well for the same business name in the past.

If you think this is something that you do not want to pursue then I will go ahead and let the attorney know so they can put the file in archive so if there's someone else looking for the name can obtain it.

If you want to keep the name, you can simply submit the fee and you will be able to receive the serial number accordingly. "

Mark

Phishing scam

About a month ago, Pixels Logo Design contacted me for the same issue as a previous reporter. Someone else wanted to trademark my logo/business name. I initially deleted these emails because the company name they had listed in the email was incorrect (listed INC not LLC).

This was also for a logo they did for me back in 2018. So I’ve owned the logo for quite some time, and it is on published books out in the world.

What made me engage with them was they texted me. That’s what made me think it was real.

After texting with them, I consulted with a friend who also happens to be a parent and trademark lawyer. He suggested I trademark it first. So I did.

I informed Pixels I was going to trademark it myself… and did so for $350.

I did NOT pay them a dime, thankfully. But this cost me money, anxiety, and worry and a couple sleepless nights.

Don’t use them for your design purposes. Hire an individual. It might cost more, but you won’t be put in this position.

I hope others find this helpful!

Scammer contacted me with a message about another company wanting to trademark my business logo. Scammer said in a phone conversation since they created the logo for me years ago, and a new client wanted to trademark it, out of consideration for me being the first client, they would help me trademark it but I needed to decide that night because they were going to help the other client get the trademark if I didn't want it. The message came after business hours on a Friday night. 5:40pm. They were pressuring me to make a decision by threatening me with the (supposed) other party about to pay for trademarking my logo image, business name, and slogan. The individual I spoke with said she had 4 years experience with trademarks, would do all the paperwork, and wanted to charge me about $1,700.00 since she wanted me to file under 3 different classifications, and each cost $350-$410, plus a search and other trademark expenses.

After speaking with a lawyer on LegalZoom.com, I learned all 3 classifications the scammer gave me were wrong, plus it's best to use only one classification to file. The lawyer advised I owned the logo since it was 6 years old, on my website for 7 months, and covered under the "work for hire" law. If I had given the scammer any money, I would not have gotten a trademark since the classifications were wrong, and she could have come back to me for more and more money to continue the process due to her filing my request in many ways wrongly. I fired this company 6 years ago for doing such a poor job creating a website, and got my money back, except for the charge for the logo I created, but needed them to put into photo shop.
