I found a studio rental for my brother in Kailua via FB marketplace. Listing agent is Tom Summers, a real estate agent. We communicated frequently via text, messages, and email. A fully refundable partial deposit ($500)was made via Venmo to take the ad down and arrangements were made to see the unit. Tom sent pictures of his drivers license and that of the units alleged owner, Rick Emens. We have a signed rental agreement. The day before my brother was scheduled to move in, Tom calls and said the owner was thinking of extending current’s tenants stay be abuse they were offering more money. If I gave him the balance of the deposit( another $500), he would convince the owner to not extend the current tenants stay. Tom guaranteed my brother could move in as scheduled. The morning of the scheduled move in, Tom emailed and said the owner extended the current tenants stay. At this point, I had lost all trust and requested my deposit to be refunded. Tom made excuses for the delay in getting my refnd ( Emens was too busy and will do it later, PayPal wouldn’t let hi, send my refund even though I sent him a money request via PayPal, he was taking his family to the beach and couldn’t take 5minutes to meet me, etc). Tom only emailed or texted and refused to call me to discuss. Feeling that I would not get my refund back in a timely manner or at all, I filed a dispute via Venmo. Tom and Rick refused to return my deposit unless I cancelled the dispute. I refused to cancel the Venmo dispute until I received my refund. Tom deleted his FB account.I found Rick Emens on FB and he also refused to refund my deposit until I cancelled the dispute. He stated the dispute “froze” his Venmo account. I gave him the option of paying me via PayPal, or cash and he refused. Eventually( after 2-3 weeks), Venmo refunded my money.

Tom Summers is a real estate agent who manages property. Rick Emens is not listed as the owner on public property tax records.

I have filed a complaint with the real estate licensing board and hope that others will not be scammed by these two people. It has been a financial and stressful experience that no one should have to go through.
