I answered an ad on Instagram about boudoir photography. This company, Sacral Boudior, told me I had to pay 199 dollars upfront to schedule the appointment for a "model call" and that I would lose a slot that was going fast if I did not book, I was also told the non-model call fee was 800 dollars. The $199 fee was non-refundable. They sent me many emails but their website says nothing about how much their packages cost, and most of my research of this company was done through their website. They only had 3 Google reviews when I first looked them up, and no Yelp reviews. I assumed they were a small up-and-coming business. I am young and a little careless when it comes to reading emails, I have so much spam so I didn't read them all carefully, they did include in one email an attachment of a photo of the package prices but it was lost in between their emails about signing a contract. The company kept pressuring me to sign the contract (for three days after paying the fee) and when I did I was able to confirm my photography date, I signed the contract officially on 7/19/2023. I went in and got the photos done on 8/11/2023, everything seemed normal except the photographer wasn't the woman who the website said, Jana Lewis, apparently she was only the owner and another woman named Melissa was the actual photographer. After photographing I was told to come back a week later to see the photos. When I went into the studio on 8/21/2023, I was told by Jana Lewis to pick out thirty photos and only after were the prices verbally shared with me. I was completely blindsided by the price of the packages, as I had not read the previous email as it was buried in all their other emails from them in my inbox. I was then told I would lose all my photos and the 199 dollars booking fee if I did not purchase photos or a package on the spot. I asked for a payment plan and was told I would not be getting any products until I paid in full. The cheapest package was 999 and one single picture would cost 199. I was told all pictures would be deleted after I left if I did not purchase them on-site that day. In order to get all 30 photos I had picked out at the beginning of the meeting I would need to purchase a package for 3,999 plus tax. It was supposed to include all 30 digital images, a 2-picture folio, and an album with 12 spread photos. 800 dollars of that package could go towards more photos or it would be gone, meaning 800 out of 3999 dollars was for print credit that I would not be able to get back if I did not use up in my purchase that day. I asked if I could have a couple of days to think about it and Jana told me my photos would be deleted after I left the studio that day. I felt like I couldn't say no, especially after driving four hours total (back and forth), getting my hair and makeup done plus the photoshoot which took 6 hours on 8/11/23; I felt like I had no other option but to buy the 30 images Jana had told me to pick out at the beginning of the meeting and the only way to do that was to buy a package or pay 6499 for my photos without the other additional items. Jana told me verbally that it would take 3-4 weeks to get my package products to me and I asked her to ship them to my home so I would not have to drive so far again. I left the studio that day after paying 4,132.50 and empty handed. 45 days later I had heard nothing back from the company so I called the number on their website and left a message. I asked where my package was and to get a tracking number from the shipping company. I began tracking the calls and emails at this point and recieved a text from Jana's assitant telling me that the contract I signed said it could take up to 6 weeks to get my products. I waited another week after that since I had called on the 6th week and that Jana would call me that day (October 6th 2023). On October 9, 2023 Jana reached out to me saying that she would call me 10/10/2023 at 2 pm. Before going on the call I carefully reviewed the contract once more and realized what had happened. Here are the clauses that I felt forced me to get stuck in paying that much for no product,

"STUDIO shall not be liable for its failure to fulfill its obligation under this Agreement, if such failure is due, but not limited to; an act of God, extreme weather conditions, inevitable accident, fire, lockout, strike or other labor dispute, riot or civil commotion, act of public enemy, rule of any government or governmental instrumentality (whether federal, state, local or foreign), failure of technical facilities, pandemic, failure or delay of transportation facilities, or any other cause of a similar or different nature not reasonably within reasonable control." "REFUNDS AND NON DISCLOSURE AGREEMENT: Should the Client receive a refund for any reason whatsoever, the Client agrees to not leave any negative reviews or comments on any websites, forums, or social media, etc. The Client agrees with this term both in conjunction with the signing of this agreement as well as acceptance of the refund. Should the client not withstand this agreement, legal action will be pursued by the Photographer." "THE CLIENT agrees that all albums/products must be paid for in full before work will be started on them. Once payment is made, no refunds will be granted for any reason." "COMPLETION SCHEDULE: Prints shall take 6 weeks from time of print order at your in person viewing to be processed and delivered to the Client. An expedited fee of 10% of the order total shall be applied to expedited product requests. The Photographer is not liable for delays due to manufacturing and/or shipping. All un-purchased images are subject to immediate deletion upon conclusion of the Reveal & Ordering appointment. Purchased images are subject to deletion thirty (30) days after final products have been received by the Client. Deleted images are not recoverable and proofs are not held for any reason." "FINAL SALE: All sales are final. All monies collected by STUDIO are non-refundable. No refunds will be given on the Session Fee or the Order. Once the Client places an order for physical and/or digital products, the order is final and may not be changed, altered, reduced, or canceled. This stands for both payments in full and payment plans. No refunds will be given on products after the order has been placed. Pre Session Payment Plans are not refundable should the Client choose to cancel their session or place an order for an amount less than paid via the Pre Session Payment Plan. Should the Client choose to reverse payment, the Photographer will send a bill to Collections or pursue legal action to collect payment."

I was scared that if I reported the charges as fraud to my bank that Sacral Boudior would sue me and persue legal action. On 10/10/2023 Jana told me that the manufactuer was out of the materials I had picked out for the products and that she had forgotten to call me about it. She told me if I picked out alternative materials that she would expedite the product to me. I picked out new materials but am unsure if I will get them and because of the contract I was afraid to go to my bank to report fraud. I haven't spoken to her since Friday, 10/13/2023 but am unsure if I am going to get my products. My bank is invetigating but due to the contract I do not know if I can get a refund. At the worst this is a fraudulant scam and at the best this is very bad business practices with poor communication and coercivse tactics. I will also be filing a police report and calling a lawyer.
