I reviewed the more than 1500 pages for her within a few days. On 5/18/22, I phoned her to discuss the case and let her know my opinion (which she was not pleased with -> the case appeared frivolous and without merit to me). I sent her an invoice by email and regular mail on that date for the four hours of work at the rate that she had agreed to ($800/hour x 4 hours -> total $3200).
She has repeatedly refused to pay the invoice.
She suggested in her 16:00 PM 5/18 email (after she had already agreed to my fee schedule, I had completed the record review and she had received the invoice) that we could "perhaps work out an arrangement regarding payment so that I can work with you within our budget."
When I reminded her that she had sought me out, reviewed my CV and fee schedule and sent me the medical record link, she changed to attacking my medical expertise.
On 6/2/22, she sent an email stating "I am attaching a record from -x-x- saying that Mr. -x-x- had a high titer at the time he claimed to have been off of fluconazole for 3-4 months.
I am objecting to your invoice on this basis."
This item really had nothing to do with the fact that the patient had received appropriate treatment for his infection, and may have had pre-existing injuries prior to his infectious disease issues that accounted for the problems he was suing the Arizona Department of Corrections over.
She has continued to refuse to pay for my services rendered.
I have not had a single experience like this in 30 years of assisting attorneys in San Antonio, Phoenix or Tucson with their legal work.
I have worked with individual lawyers, large and small firms and with MICA here in our state.
When I contacted the Arizona Bar 6/14/22 regarding Ms. Scheff's unprofessional conduct, I was encouraged to sue Ms. Scheff and her client for payment, and to file a Charge of Misconduct with the State Bar of Arizona. My contact at the State Bar indicated a dim view of what had happened, and apologized, urging me not to stop assisting with legal work in the future. He indicated that I might wish to offer my services to the opposing attorney in the case, as it seemed that the case was frivolous, and I had no agreement of confidentiality with Ms. Scheff.
