They had us sign a contract that gave me a bad feeling at first, but I figured that this was a normal occurrence since this was my first time receiving a quote for a project this large. Early on in the construction phase, I started to notice that they weren't doing the project as their website advertised and I saw many faults happening with their method of construction. They had a tiny crew for the size of this project and no one seemed to know anything about the details of the project. I told the lead contractors about my concerns, but they went unheard. The owner who was supposed to be the project leader was out hunting. I called the owner, Sabel Wilder, and his VP, Cristi Powers, but even though I insisted that the project was not being done correctly, nothing was being done about it, despite my efforts.
Then on October 11, 2020 we had a rain storm, which caused major water damage to our home because of the negligence of these contractors. They had uncovered our entire roof, but didn't have enough experience or man power to waterproof our home, nor did they use any tarps to protect our home from the rain. We came home to it raining in multiple areas of our home. That evening, we contacted the owner, Sabel Wilder, and he said that there was nothing he could do right then and that he would send over his water mitigation experts the next day.
The next day, he arrived and I complained to him about his management of our project and the water damage. We wanted to fire him, but our roof was still torn off and we were now headed into the rainy season. He also threatened to sue us since we had signed his contract. We had already paid him 50% of the project price and our roof still was exposed, so we felt like we had no other choice but to let them try to complete the work, even though we knew of problems with these contractors. Sabel brought over who he said was his "water mitigation expert" and that man took notes about the damages, but he was never seen again.
The project started in mid September and was to be a 10 day job. Sabel was trying to finish up, but there was still much to be done, and on around October 24, I would be leaving for a week long previously planned trip. We paid Sabel an additional $20,626.80 towards the contract and we would settle up upon the first few days of November when I returned and we went through our contractional "walk-through" when he said he also would be finished with the work. When I returned, most of the work still remained unfinished. Sabel contacted me through text and said he would like to receive payment and do a walk through. We responded that we would be happy to make the final payment, but we would need the promised repairs done and the lien waivers that we had paid amounts upfront for which we had previously discussed.
That's when Sabel's attitude changed for the worse. He demanded payment immediately even though he didn't complete the work, finish his verbally promised repairs, present us with the lien waivers that we advanced payment for, or even give us a final bill amount due. He said that if we didn't pay him immediately in the next 72 hours, he would add an additional 10% of the entire contract price as a late fee.
At that point, I contacted the CCB to begin the process of filing a complaint and also wrote a negative review of our experience.
Then Sabel went silent for the next 7 days. He then sent us a demand letter for the amount due plus a 10% late fee of the total contract price with threats of additional $10,000 of legal fees if we didn't pay. This was our first notice of the final amount due of $7,728.71 plus an additional late fee of $4,489.23. All of this for a project that is still incomplete. We dropped off a check for the $7,728.71 to hopefully be rid of this horrible contractor, but he mailed it back to us with a note saying that if we didn't sign another contract of his that we would remove our negative review and never write another one about the company then he would continue with a lawsuit against us for non-payment.
We spoke with our lawyer who advised us that this was a scam and that we should not try to make an additional payment of $7,728.71 since he had already rejected it.
Because of my suspicions of the work, I hired two additional inspections of our roof. Both inspections showed that this contractor was not able to perform the project and gave greater details into the faultiness of the construction. We paid over $8,000 dollars out of pocket for damages to our office, we still have major repairs needed for our drip edge which was installed incorrectly on the entire home that is preventing us from having gutters put on, there was no ventilation put in properly, flashing was installed improperly, the shingle patterns lead to future water intrusion, and large amounts of material that we paid for were taken off-site to an unknown location. With our lawyers, we sent over this information in hopes that he would work with us to resolve the issue, but they kept arguing that we didn't make payment and were insistent on entering into litigation, even though Sabel rejected our payment from us; never sending us a final bill before his demand letter with the late fee, and rejecting our payment if we don't enter into another contract to take down our review and prevent us from making another. After raking up $15,000 in legal fees fighting against his claim, he placed a lien on our home by misrepresenting his attempts to collect payment from us. Eventually, he and his lawyers were able to extort over $21,000 from us because we didn't have the resources at the time to fight against his claim for an unpaid balance of $7,728.71 which we already ended up paying an additional $36,000 for.
