Writing in regards to the garage job recently cancelled, I have the list for you in this e-mail for the
pay out/ expenses that we paid out for your quote for all or any addition work that would have been required pending the garage job was to go ahead.
Carpenter/Lead hand: $350.00
Human Resources Manager: $400.00 with paper work and re-quotes of of job.
Reserved non-refundable jack hammer: $50.00 a day
Reserved non-refundable Excavator: $300.00 an hour
Returned trip to home owners home to revamp and re-evaluate the blue prints and whole job spec's on the
garage: $600.00 in man hours
Security holding fee to secure and obtain us as contractors for this size project: $2000 non-refundable
Project cancelled only 3 days before start of Project: $285.00 non-refundable
Total amount/expenses: $3870.00 non-refundable
Amount owing/refunding back to customer from deposit made: $5295.00
The amount owing/refunding back to you will be held for 90 business days for any addition expenses that may be billed to T-n-T Reno's by any sub-contractor's or other expenses that we reserved for this project, we secure this hold to ensure we are not responsible for providing funds/monies for customers projects. The
refund for the sum of $5295.00 will be returned to the customer in full on February. 1st 2017 and will be paid through e-mail money transfer (EMT) the same way it was transferred to T-n-T Reno's
First of all, Chris did not provide a written contract and neither did he inform me that there will be a security holding fee of $2000 prior to me paying a deposit. As there was no contract in place, all agreements done via e-mail that may be termed a contract did not specify the terms of cancellation and I did not cancell the project but only postponed it.
Secondly, Chris claimed he spent $600 in man-hours to visit my house to re-evaluate the project, his visit lasted less than an hour with my wife providing all the that he used including the pens and papers for his sketch. He didn't provide any evidence of the calculation and just stated an arbitrary amount.
His calculations and deductions are fraudulent and designed to cheat me, even his supposed refund calculation is wrong. I paid him $9693, He claimed total amount of expenses of $3873 and his refund of $5295. Simple arithmetic calculation shows that $3873 deducted from $9693 is $5820 and not $5295 as he claimed.
At no point did he state or we agree that he will hold back my money for a period of 90 working days in any of our discussions via e-mail should in case I cancel the construction which I repeat I didn't cancel but postpone. Also, you cannot reserve equipment and personnel when you do not have the permit to start a job.
Chris considered the postponement a cancellation and decided to make frivolous charges that I consider fraudulent and unfair business practices. I am new to Canada and the province and I am sure he is taking advantage of the fact that I am new and naive to the practices and requirement in this province.
Chris and TnT renos have till date not returned any part of my money nor have they responded to e-mails and the phones are no longer workin.
