I hired Miguel Hernandez; The Outdoor Room back in September 2018. He told me that the project would take about two weeks and he asked me if he can start the project while waiting for the HOA approval. He told me that I don’t need to pay him if it does not approve. Now I know his intentions is to get my deposits as soon as possible. For what he promised me, I let him start with the project. Just verbal agreement he brought in his tractor the next day and told me that he ordered the materials with his own money already and acted himself like he moving quickly on the project. He asked for the first deposit when he brought in the contract. It is $30,000 project and 1/3 of the payment needed to make when we signed the agreement which I made the first deposit on 9/27/2018 and he told me that the materials will deliver the next day and I will need to pay him the second payment. Which the materials never deliver until beginning of November. When I made him the first payment he moved very slow on the project unlike what he told me how fast he can get it done. His guys only showed up about three days to build the wall and digthe line for the gas line. Now I found out the wall that he built didn’t get a permit for it. For payment of $20,000 that’s the only things that he done and brought in some materials which is not enough for the project. The nightmares begin after the first payment I made, he didn’t show up to work. I called and texted him he didn’t response. He didn’t give the the drawing until a month later for me to submit to the HOA. When he finally got the drawing for me, he started asking me for the second payment. I refused to pay him at that time because I have a feeling that he can’t be trusted. Day by day I have a feeling that he trying to scam my money. He keeps bothering me getting the second payment and I kinda ignored him. He keeps telling me that he wants to finish with the project here and move on to the next. Also he needed to move his tractor to the next job. I told him that I won’t pay him until HOA approved and the materials delivered. Since he wanted the payment badly he kept asking me have HOA approved. Finally it got approved in about a week, when he knew that it approved he asked for the payment. I told him I won’t pay you until the materials delivered and you begin working. He had the materials delivered next day after the approval and said that they will be here working and will be done soon. After the second payment, he just disappeared, not even to show up to work until then. I kept calling and texting him didn’t get responses from him at all. He only answered me whenever it was bad weather and told me that he and his guys will be here to work. He stored all the materials that delivered on the street for over months. The city sent a violation on January 2019, but he didn’t seem to care of moving it at all. I have the city call him directly because I couldn’t get him to do it at all. I sent him the notice on January 14, 2019 and he finally got it moved on January 30, 2019 just only the dirt and not even the materials. A month later the HOA start complaining about the materials that have been on the street for over months. HOA gives him two weeks to move it to the backyard but he still didn’t do anything at all. And about a month later HOA sent me a second violation and I let him know about this. He blame on HOA doing this, he is mad and said that he’s right about this issue. He told me that he will go to city and get permit for him. He just said and didn’t do. All these issues stressed me out, I keep bothering him every day until he fixed it because I couldn’t sleep at all during this time. He keeps telling me that he will come but never shows up. I texted him that pavers fallen and needed to be taken care immediately it is very dangerous but he still didn’t show up. Finally I get him in, he fixed him tractor and move just 2 pilots out of 10 pilots on that day. It took him three trips to get the pavers moved. Finally on April 3, 2019 he moved all materials back to the backyard yard. He always been telling me that he needed his tractor for my project, but still 90% of works aren’t done he pulled his tractor home. On that day he told me he will meet with me at the city to get permit for the gas line the next day. Which didn’t happen and I asked him when can we go, he did not reply me back. Everyone here talked about him is true. He is a big big liar. When he tells you something just don’t expect it. He just said it not meant it.
