I am writing on behalf of my mother who was the victim in this transaction. Thetoycaptain.com showed up on her credit card statement which arrived today 2/16/2023 with a transaction 1/29/2023 for $39.99. She could not recall making any transaction for that amount or from that company. I located the website and contacted their customer service number to determine what, if anything, had been ordered just to see if we could figure it out. I spoke with a person named "Antonio" who at first attempted to talk me in circles about a "terms and conditions" agreement from a purchase back in August of 2022. My mother had received in the mail a set of face creams from Advanced Vitality in August 2022 and recalls calling and immediately canceling any further shipments of the product as it came with a 14-day trial notice. She does not have the notice any longer, nor does she remember what company she contacted to cancel. We reviewed her credit card statements for that month and the month prior and see no unusual purchases. The website for the company is obviously not professionally made and contains no mention of any products other then children's toys. When I asked why this was so but they claimed to have shipped facial creams my questions were deflected. I instead decided to inform Antonio of my position as a recent law school graduate who was concerned of fraud and potential bad business practices. He said this most recent charge was for a fitness app that was "included in the terms and conditions" of the facial cream. I informed him that this made no sense and that I was requesting he return any funds acquired through my mother's credit card since the initial purchase. He informed me that all other attempts to charge my mother's card had been blocked and there were no additional charges to return other than this one transaction for $39.99. I informed him that this appeared to be a form of fraud if all other transactions were blocked and now months later he was attempting to charge her for a seemingly unrelated product without her knowledge or consent and that if the money was not returned and all attempts to collect any funds from my mother were not stopped immediately I would be reporting his business to the better business bureau and the attorney general's office for both Tennessee and Massachusetts which would likely cause a headache. He became a bit frustrated with me at this point and basically said he would return the money and cancel "her account." They had her name, her address, her phone number, her email and a credit card on file. Given the amount of information he had, the general sketchy nature of the website and the fact that a short internet investigation lead me to Ivan Being Inc. being a corporation that created in January 2022, but with no other internet activity as the affiliated company, this appears to be a potentially problematic. It should be noted that my mother is in her 70's and does not make online purchases rather she utilities the phone order system for QVC and that's about it for shopping so I have some concerns about predatory behavior toward the elder generations. Antonio gave me a confirmation number of *** to reference for the cancelation of my mother's "account" and return of funds but refused to release his supervisors name or send a confirmation email to my mother account. A quick search on her only email account showed no contact with either company named in this report or the company that the facial creams have on their label.
