I am a veteran owned small business. Thomas Gutierrez called my office asking if we needed an estimator after finding our website via google. We met with him and he claimed he was bored of retirement and wanted to help a small company grow. I entered into an Independent Contractor agreement with BTC LLC on March 17, 2022 that included an NDA and protection of our customers and leads. He began asking us to fill out very extensive and sensitive information about our company for a prescreening to win jobs, which I found out he did with another company as well.
He was caught bidding the same leads for a competitor Demolition company. After speaking to that owner, BTC LLC had been estimating for that company for 5-6 weeks which is a breach of our Independent contractor.
We spoke to another company he listed as a previous employer, For multiple months BTC, LLC "estimated" for them and brought in no closed contracts and collecting fees from the company. Also, he kept using an email from that company and stealing bidding work using that email on bidding sites.
Tom Gutierrez contacted multiple clients of ours after we caught him and continued to ask for the work for another company which is a breach of our cease and desist after terminated our independent contractor agreement with BTC LLC.
We believe Thomas Gutierrez has done this to dozen of companies and is manipulating young contractors. We also found out that he stole $3000 from a lady almost 30 years ago. BTC LLC and Thomas Gutierrez is fraud and con man.
I've reported him to the State Attorney General and FBI White Collar Crimes.
