They are correct that i have not filed a trademark for my name, but I don't see the need. i highly doubt someone else is really engaged with them trying to use my name, this is just straight up extortion and this guy should be disbarred (it seems he's a real lawyer) for such practices.
if you lookup their phone number, they have several brands they've setup all using the same info, but different websites. Nothing illegal about doing that, except in this case it's likely so they can mass email people to trick them into falling for this scam. I call it a scam because there is no other party looking to use my name.
look at the subject of the email. they screwed up one of the variables to replace "business name" with my actual business name.
that's because this is a cookie cutter mass email they're sending to everyone to trick them into thinking they may lose their business and specifically profits earned while using the name. That is not how this works. They would need to prove damages and as they clearly stated, I have been using this name for a while. So how would me using the name cause damages to another party who wants to register it as their own trademark? the answer is... it wouldn't.
AKA - its a scam
