The technician finished his inspection, told us the tank had a bit of sentiment in it but would last another couple of years. He then proceeded to give us a sales pitch about the benefits of a tankless system. Thinking he was from Reliance we agree to an installation.
On 2 November 2022 two technicians arrived and said, “we are here to install your new tankless system”. They offered no ID. At this point we had not been presented with a sales contract and we had no idea of what the terms of a sales contract would include. No sales person from Enerite ever came to our house. No person from Enerite ever gave us a sales presentation. No person from Enerite ever asked us to sign a contract.
The two technicians removed the Reliance hot water tank and installed their own tankless system. After the installation was completed, as they were leaving, we were asked to sign a signature pane on their electronic device. We accepted that request as an acknowledgement that the installation had been satisfactorily performed. We had no idea what other documentation was on the electronic device. However, we trusted Reliance and they promised to send us a copy of the documentation. They never did.
On 13 January 2023 we received our first rental invoice which was billed through Enbridge Gas.
I spoke to the billing company, Simply Smart Financial Inc. saying we did not have a contract with them. I had never heard of Simply Smart Financial. After some investigation into who Simply Smart Financial was I again talked to them.
On 31 January 2023 I spoke to Ana at Simply Smart Financial and asked her for a copy of the contract. She e-mailed me a copy of a sham Enerite contract on 31 Jan 2023. This was the very first time we had ever seen this contract. We had had absolutely no contact with Enerite since the installation. We didn’t even know who Enerite was until recently. We were, however, still being billed monthly by Reliance for the hot water rental.
I immediately cancelled the contract verbally saying it was illegal.
I mailed two letters to Enerite, one dated 1 February 2023 and the second dated 7 February 2023 further stating our demand to immediately cancel this sham contract.
We have never received a reply to either of those letters.
On 28 Feb we returned Enerite’s equipment.
The first request we had to pay for the returned Enerite equipment came in the form of a lien on our property dated 30 May 2023, registered by Simply First Financial.
