This report details the activities of certain individuals or groups who are engaging in unlawful fintech operations by bypassing industry standards and regulatory requirements. These entities are exploiting existing banking and fintech platforms to issue and resell virtual cards without proper authorization, Know Your Customer (KYC) checks, or compliance with Anti-Money Laundering (AML) and Countering the Financing of Terrorism (CFT) regulations. Furthermore, these services are potentially providing access to the European and U.S. financial systems for individuals from sanctioned countries, posing significant risks to financial stability and security. . Description of the Unlawful Activities

• Unauthorized Access: The perpetrators have joined existing banks or fintech platforms that provide API access to their customers. Instead of forming a legitimate company and undergoing the necessary due diligence, they are using their personal or company accounts to access and resell banking services.

• Reselling Virtual Cards: These individuals are creating and selling virtual cards to third parties, who are not authorized or known to the original service providers. The cards are being sold without any KYC verification, allowing anonymous access to financial systems.

• Violation of AML/CFT and KYT Regulations: The platform allows for the balance on these virtual cards to be topped up via cryptocurrency wallets. Crucially, these wallets accept cryptocurrency from any source without performing KYT procedures, which track the origin of the funds. After receiving crypto, the platform sends fiat currency from other, seemingly unrelated, sources to these cards. This practice not only violates AML/CFT and KYT regulations but also facilitates potentially illegal activities by allowing virtually untraceable transactions.

• Involvement of Sanctioned Individuals: It has been observed that some of the users of these services are from countries that are under international sanctions. This is particularly alarming as it allows sanctioned individuals to gain access to financial systems that should be off-limits to them.

This lack of oversight poses a significant risk to the financial system, as it enables the creation and use of untraceable financial instruments.
