On March 13th, 2023, I contacted XpressMark company to aide with filing HR Custom Furniture Co. trademark slogan of “Life In The Left Lane!” for my Buissnes. They told me it would cost me a total of $735.00 to register the slogan with the USPTO which includes the minimum required of 3 classifications out of the 4 classifications. XpressMark would then assist with completing the paperwork and filing with the USPTO on my behalf, and at the time of filing I would receive a filing receipt with a serial number which can be used to track the status of the application after it's filed, however, the USPTO takes about 3-6 months to assign the application to an available examining attorney, who will manually review the application and decide on the approval. And that this entire process may take 7 – 12 months to approve. Now after multiple times of contacting XpressMark since then concerning my application serial number from the USPTO and getting the runaround with the same excuse time after time, that the “USPTO has a backlog and its taking longer then usual” and that “I may start using the TM symbol in business and commerce, which enforces your trademark rights as you are legally protected.” I then decided to followed up by checking the USPTO cloud-based trademark search system to search for pending and live trademark applications and registrations. And as suspected and much to my disappointment, my slogan of “Life In The Left Lane!” nor my name as owner of slogan were to be found on their system.
Now after applying continual pressure on XpressMark to furnish evidence of USPTO filling and application serial number, on January 19th, 2024, I received a questionable filing receipt for my Trademark application of “Life In The Left Lane!”, and as usual no USPTO assigned serial number to filing receipt. Shortly after, 3 days later on January 22nd, 2024, I received an email and followup call in order for me, “to ensure I understand everything as this is the last plus and most crucial step that will determine the approval or rejection of the filed trademark applications of business name that is active & live on USPTO's database under your name”, with an additional cost “As per the requirement of the government the filed Trademark Applications needs to be attested and endorsed by the US state department, For the trademark to be recognized by the governing authority in the United States.” An additional $2000.00 which includes a “50% discount” and needs to be paid before end of week. “A one time inclusive fee of all the taxes, fee and surcharges nothing hidden or recurring as this is the requirement of USPTO we need to address it before end of next week to fight the petition and further make the application stronger overall.” And “If you failed to complete the process, we will consider your application abandoned. For example, if you don’t respond to this office action by its deadline, we will declare your application abandoned and send you a notice of abandonment.”
I then contacted the so called “Senior Case Filing Officer, Rachel Jones” and after explaining that this was not what was stated at the begin of the process and that I asked the previous “case officer” at the time of starting the process with XpressMark, if there were any additional cost, she told me that there were none and assured me that they only charge $35.00 for their service and the additional $700 are mandatory USPTO classification filling fees of $350 per classification and at no time did they disclose such additional fees. I then proceeded to request the filing serial number of my application and the Attorney on staff Bar Number of which she immediately changed her domineer to an intimidating and threatening one, and sated that she will not provide the serial number of my application until I paid the additional $2000.00 and that the Attorneys Bar number is of no consequences to me and will not be disclosed. After some unprofessional back and forth I reiterated that I will not be paying the additional fee as this is extortion at this point and she followed by stating that she will declare my application as abandoned of which I proceeded to end communication at this point.
At this junction in time it is evident that ExpressMark LLC. is running a full-blown scam and preying and defrauding people of their hard earned cash, and for a small Buissnes owner like myself, $735 is a painful great loss to my business when trying to keep afloat. My last hope and prayer is that Better Business Bureau will help protect others from becoming victims and help Law enforcement investigate and stop this type of extortion of victims such as myself from XpressMark LLC.
