A guy (John) stopped by my house while I was outside putting up Christmas decorations. He told me he and his crew were just finishing up paving a driveway for one of my neighbors around the corner, and that he had some material left over and that if I was interested in it, he said it would be and look like the road in front of my house and they would give me a really good deal. He told me it would be about $4000.00 to pave it all. I told him I couldn't afford that much and then he told me it would be about $2000.00 to do half of it. He said he would have his brother stop by when he was finished with the other job and discuss the cost with me, but in the meantime, he would send over one of his guys to start grading my driveway. About 20 minutes later a guy came over on some grading equipment and started grading the WHOLE driveway. About 20-30 minutes later two guys in a truck pulled into my driveway and one (Danny) got out and I asked him why they graded the whole driveway and he said, "just so it's all graded evenly but don't worry about that, he's paying for it, I won't even charge you for it", and then he said, "he needed my John Hancock on this piece of paper". I told him I wasn't signing anything until I knew what the cost was for what I was having done. He told me I was signing for 2.50 per foot to have HALF of my driveway tar and chipped sealed. He walked over to the edge of my concrete driveway and motioned with his hands and said, "so we're going to go from this edge of the driveway all the way out to the road" and I said yes. He said "he couldn't give me an exact price because it's almost winter and he's just trying to empty out his trucks and he didn't know if he even had enough to do half of my driveway. So, he wouldn't know the final cost until he emptied the truck and could measure how much they did". It was about 9:00 at night and dark and cold outside. There was nothing else on the paper but the 2.50 per foot, so I signed the sheet of paper agreeing to that. I asked him for a copy, and he said I would get one tomorrow when the job was done. I asked him "If I liked the work they did and wanted them to come do the rest of the driveway if they could do that? He said "yes, if I you like the work and want to do the rest, he gets his materials from Vegas and could come do that". Then he said they would be back at 9:00 or 9:30 am to get it done. They showed up at 11:00 am. When his crew showed up, they started rolling and prepping the WHOLE driveway. I walked out and told one of the workers, "you know you're only doing half of the driveway, right"? He said, "he was told to do it all and that he needs to know because he is the one spraying it. He said let me call my boss" and the proceeded to call someone. A few minutes later (John) the original salesman shows up I told him they're only supposed to be doing half the driveway and he said, "It's whatever Danny and you agreed on, you did sign a contract right?", I told him Yes, I signed the contract and that we agreed on only doing half the driveway. I asked him if I have them come back and do the rest of the driveway would it still be $2.50 per foot and he said yes, it would be $2.50 x however much they do. and asked me again if I signed the contract and then left. The workers continued to prep the WHOLE driveway. then they started to spray the driveway with the oil/tar mixture and then putting the rocks on top and rolling it in, but they didn't stop halfway and continued on. So, I called John and told him they were going past the where I agreed to have it done and I wasn't going to pay for it. He said, " isn't Danny there yet"? and I told him know I haven't seen or heard from Danny at all today. John said he should be there shortly. When Danny did show up, his crew had sprayed the WHOLE driveway and were putting down the rock and rolling it in. He walked up to me, and I told him I only agreed to having half the driveway done, he shouted at me and said, then who gave them the authority to do it all"? I told him I don't know, your guy said he called his boss, so I'm guessing you did, they don't work for me. He started yelling at me and telling me I told him I wanted them to do the whole thing. I said I asked you IF I wanted you to come do the rest of it at a later date if you could and you told me yes. He started yell and twisting everything that was said between us and threatened to rip it all up. I said do what you think need to do but I'm not paying for it. He said, well, let's measure it and see where you're at. So, he went to his truck and got out his measuring device and came and measured half my driveway at the widest part and told me it would cost me $3300.00 to do half my driveway. I told him his brother (John) to me it would be about $2000.00 for half of the driveway and about $4000.00 for all of it. He said, "his brother is a salesman, and I can't go by what he said," I said, "Then why is he out here selling to people if he doesn't know the price of what he's selling?" He said, "let me measure the rest of it and see where it's at and I'll make you a deal", so he half-assedly measured the rest and said it would be about $7000.00, but he would work with me. I told him his brother said it would be about $4000.00 for all of it. I told him to dig it up and leave I wasn't going to pay that much and turned to walk away. He started yelling at me and telling me he would give me a really good deal and only charge me $4,500.00. By that time, I just wanted to get rid of him, so I agreed, thinking I was getting a good deal. He went and filled out the Invoice and brought it to me and said let's go in your office and finish this up. I didn't want him in my house, but he followed me in. I went to get my credit card and he told me he doesn't take credit card. I told him I don't have that much money in my account, and you need to let people know this ahead of time. He started yelling at me and got in my face and said the credit card companies charge him 47% so he doesn't accept them and why didn't I tell him I was going to use a credit card ahead of time. I was really uncomfortable dealing with him, I didn't know how far he was willing to go to get what he wanted, and I feared for mine and my 86-year-old mothers' safety who was staying with me at the time. I wanted him out of my house, so I wrote him a check for the $4,500.00 knowing I didn't have the money in my account, just to get him out of there. He left before the job was done and about 20-30 minutes later his supervisor said he was on the phone and wanted to talk to me. He was at the Credit Union trying to cash the check, but they told him there was Insufficient funds and he couldn't cash it. I said, "I told you I didn't have the money in that account and I'm not transferring any until the job is done to my satisfaction. He said, "so what am I supposed to do, sit here and jack-off until you transfer some money"? I told him I don't care what you do" and handed the phone back to his supervisor. I waited for the workers to finish the driveway, but it never did look like the road. I asked the supervisor about it, and he said' "it could take a few weeks to fully compact but the more you drive over it the sooner it would happen. It's been a month, and it gets worse the more it's driven on not better. I considered whether or not to transfer the money, but I was afraid he might retaliate in some way or another and I just didn't want to risk it with my mom being here and all, and I just didn't want to deal with him again. They knew from the beginning they were going to do the WHOLE driveway regardless what we agreed to or what was said. I was hoping the driveway would end up being just like the road and there wouldn't be any issues but that's not the case. I had a local reputable sealcoating company come look at my driveway and he said he puts a "Consumer Alert" on all his flyers because he sees this all the time. I wished I'd seen it. He told me my driveway was not done correctly, they did not use nowhere near enough tar and oil, and they did not spray the top of the rocks with tar and oil after they put them down. He also said it should not have cost me that much since the amount and type of materials they used would have only been about $800. It was the worst experience I have ever had dealing with anyone for anything and no one should be treated like that or have to go through that to get something done for them. I'm filing this complaint to hopefully prevent anyone else from going through what I went through and maybe prevent him from doing business in Utah again. Any help you can give me in achieving this would be very appreciated.
