Following the email, I received a call from the same individual, asking that I register my trademark with them for $300. He further warned that if I did not comply, the logo they created for me could be used against me, and I might face fines. The caller then transferred me to their “lawyer,” Frank Foster, who reiterated the same points. Frank Foster provided a contact number of (281) 318-5583.
Both the email and the phone conversation emphasized the urgency of the situation.
Below is the content of the email:
SUBJECT: Urgent Action Required: Immediate Threat to Your Business Name
Dear Angela,
I hope this message finds you well. I am writing to inform you of a critical situation regarding your business name (Angela Simonelli). The U.S. Patent and Trademark Office has received an application for trademark registration from a third party for the exact same business name you are using.
If this name is important to your brand, immediate legal action is necessary. Without prompt response, the other party will be granted full legal ownership of the name, allowing them to prohibit your use of it. This means that, in addition to losing the rights to your business name, you could face serious legal consequences, including trademark infringement claims, forced rebranding, and substantial penalties.
To protect your business and avoid this outcome, we must act now. I strongly recommend that we submit your own trademark application under your personal or LLC name as soon as possible.
